MINUTES <br />CITY COUNCIL <br />JANUARY 22, 2003 <br />AMEND CUP - Mayor Fahey opened the Public Hearing to consider an amendment to <br />2935 a Conditional Use Permit to allow access to an existing second garage <br />EDGERTON - along the north side of the house and attached garage at 2935 Edgerton <br />BRETT PIRKOLA Street as requested by Brett Perkola. Fahey noted that the City Planner's <br />original CUP recommendation was that access to the second garage should <br />occur through the attached garage via installation of a garage door on the <br />back of the garage. It was noted that the Planning Commission <br />recommended approval of the CUP amendment on a vote of 4 in favor and <br />3 against. <br />Brett Pirkola reported that his access to the second garage is only <br />occasional, once in the spring and once in the fall. Blesener indicated that <br />there appears to be tracks alongside the attached garage. Pirkola reported <br />that he plans to landscape and sod the area this summer. It was also noted <br />that he constructed a retaining wall in the area to prevent erosion and run- <br />offinto his neighbor's property. <br />Fahey asked what has changed since the original Conditional Use Permit <br />was considered. Perkola reported that once the second garage was <br />constructed, he began to remove sheetrock from the back of his attached <br />garage to begin with the installation of the garage door. He then <br />discovered that the major electrical for the house runs through the back <br />wall of his garage. He also noted that he only has 7 feet, 6 inches of wall <br />space on the back gat~age wall, making the installation of a garage door <br />very tight. The grade behind the garage will also need to be ramped up, <br />and given the location of an egress window close to this area, keeping run- <br />offaway from this window could be a challenge. <br />LaValle pointed out that all these conditions existed at the time of the <br />original application. <br />Fahey asked the Planner about the use of the 10-foot side yard setback <br />area for access to the rear yard. The City Planner indicated that the <br />ordinance does not prohibit the use of this area for access. However, at <br />the time of application for the original CUP, one of the conditions <br />imposed by the City was that the side yard not be used for access and that <br />a garage door be installed in the back of the attached garage. The Planner <br />further noted that at the time the adjacent property owner was opposed to <br />the use of the side yard area for access. Given the neighbor's opposition, <br />Mr. Pirkola offered the option of installing a garage door in the back of his <br />attached garage. Conditions have not change since the original approval. <br />However, the neighbor who had opposed the access via the side yard area <br />has since moved and the new neighbor had no objection. <br />
