MINUTES <br />CITY COUNCIL <br />JANUARY 22, 2003 <br />Fahey pointed out that neighbors change and a new neighbor may oppose <br />the use of the side yard for access. Also, Mr. Pirkola could sell his house <br />and the new owner may use the side yard more frequently than the twice a <br />year that Mr. Pirkola would use it. <br />The Planner noted that the Planning Commission had recommended allow <br />the access via the side yard for a period of time to see how the situation <br />will work If it does not work, the City could then reimpose the condition <br />that a garage door be installed at the back of the property. <br />Fahey pointed out that the issue is one of expense and that none of the <br />obstacles reported by Mr. Pirkola were insurmountable. Fahey pointed out <br />that had the original CUP request been pursued with access via the side <br />yard, that CUP would not have been approved- Fahey felt that Mr. Pirkola <br />should be Held to what he originally represented to the Council, and that is <br />installation of a garage door at the back of the attached garage. <br />Montour indicated that he is disappointed that the City did not require the <br />garage door to be installed prior to construction of the second garage. <br />Fahey felt the conditions of the original CUP should be upheld. Fahey <br />noted that if the garage door is not installed, it will become an <br />enforcement issue, citations will be issued, and the CUP could be revoked. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Fahey, seconded by LaValle, the public heating was <br />closed. <br />Blesener suggested that the City allow the side yard to be used for access <br />for the next 1 '/2 years. The area would be sodded and landscaped, but if it <br />turns into a driveway area, the City could go back and impose the <br />conditions of the original CUP. The Planner pointed out that that was the <br />recommendation of the Planning Commission. If the sod is denigrated <br />because of high traffic, the original requirement for installation of a garage <br />door could be reimposed. <br />Anderson pointed out the tight space for a garage door given the location <br />of the egress window. The Planner noted that the space may be tight, but <br />it is workable. Vehicles are typically 6 to 6 '/z feet in width, so the spacing <br />would work. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />
