MINUTES <br />CITY COUNCIL <br />FEBRUARY 26, 2003 <br />Mr. Cole indicated that his intentions are to operate a hair replacement <br />business on the main level of his townoffice unit while the lower level will <br />be used for storage. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Blesener, seconded by Fahey, the pubic hearing was <br />closed. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOI, UT ION NO. 2003-2-40 -APPROVING THF. AMENDMENT <br />TO PUD TO AI,I OW A NONSURGICAL. HAIR REPI ACEMENT <br />73Ub'INESS AS A PERMITTED USE IN THE EDGEWATER <br />TOWNOFFICE PUD DEVELOPMENT AT 2598 RICE STREET AS <br />REQUESTED 73Y MR. VERN COLE, HAIR FOR 7 IP'E <br />PROFESSIONALS, SU13.IECT TO THE OPERATION OF THE <br />73USINF,SS FROM TILE MAIN LEVLL OF THE TOWNOFFICE <br />UNIT WITH EXPANSION INTO THE LOWER LEVEL. TO REQUIRE <br />ADDITIONAL, PUD REVIEW AND APPROVAL, AND SUBJECT TO <br />THE BUSINESS BEING LIMITED TO NON-SURGICAL HAIR <br />REPLACEMF,NT WITH THE.STIPULATION THAT TIZE73USINESS <br />NOT INCLUDE SPA SERVICES, HAIR CUTTING/STYLING, <br />TANNING AND OTHER TYPICAL HAIR SAI ON SERVICES <br />EITHER NOW OR ANY TIME IN THE FUTURE <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Fahey, Blesener, Montour, LaValle, Anderson. <br />Nays (0). Resolution declared adopted. <br />REZONING TO Mayor Fahey opened the public hearing to consider an application for <br />PUD & Rezoning from General Business (B-3) to Planned Unit Development <br />PUD PERMIT - (PUD) and a PUD Permit to allow the operation of an electrical <br />75 LITTLE contracting shop and outdoor storage at 75 Little Canada Road as <br />CANADA requested by Maverick Electric. It was noted that the Planning <br />ROAD - Commission had a tied vote on this request. The issue of concern for the <br />MAVERICK Planning Commission was the outdoor storage component of the proposal. <br />ELECTRIC Also, the City Planner has recommended denial of the request as it is <br /> inconsistent with the intent of the redevelopment of Little Canada Road as <br /> an office/retail/commercial area. <br />
