MINUTES <br />CITY COUNCIL <br />APRIL 23, 2003 <br />status, additional work hours over 40 per week typically go with the <br />position. Fahey suggested that the minutes be researched relative to this <br />discussion. Fahey stated that he agreed with the City Administrator's <br />recommendation to elevate the position of Accounting Supervisor to <br />department head status, and that the Personnel Policy should be applied as <br />written. <br />Blesener noted the provisions of the Building Official contract relative to <br />department head status and the additional week of vacation that is <br />provided as a result of that status. Blesener expressed discomfort with that <br />as well. <br />Fahey felt that the issue would be whether or not the City needs to <br />continue the practice of providing the additional week of vacation to <br />depa~•tment heads. Fahey felt that action on the matter should be tabled <br />pending further research of the issue. Fahey felt that bottom line was <br />whether or not to continue to support the additional week of vacation for <br />departmenC heads from a retention standpoint. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2003-4-86 -TABLING ACTION ON THE <br />PROPOSED AMENDMENT TO THE PERSONNEL POLICY <br />PENDING FURTHER RESEARCH OF THIS MATTER <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Montour, Blesener, Anderson. <br />Nays (0). Resolution declared adopted. <br />FRANCHISE The City Administrator reviewed his report dated April 18, 2003 relative <br />FEE REPORT to the issue of implementation of franchise fees on gas and electric utilities <br />serving the City. The City Administrator noted the City Attorney's <br />position that the City can implement these fees without renegotiating the <br />franchise with Xcel Energy. However, Xcel Energy may resist this action <br />without the renegotiation of the franchise agreement. Xcel has indicated <br />that they would like the franchise renegotiated fora 20-year term as a part <br />of addressing the franchise fee issue. The Adminish•atot• also pointed out <br />the very limited franchise agreement that is currently in place and <br />renegotiating the franchise would allow the City to address some areas in <br />more depth. He also pointed out that as part of the renegotiation, Xcel <br />would like to be exempt from the requirement that they have to take out <br />City permits when working within the right-of-way. <br />7 <br />
