MINUTES <br />CITY COUNCIL <br />SEPTEMBER 24, 2003 <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Montour, seconded by LaValle, the public hearing was <br />closed. <br />Blesener stated that it was very disheartening to see that Mr. Cossack <br />proceeded with the construction of this recreation building after the City's <br />repeated efforts to stop the construction. Fahey indicated that Mr. <br />Cossack either has the option to bring the building into conformity or to <br />remove the building. <br />Montour noted that this issue has been going on since June of 2002, and <br />asked if the City should proceed in a normal fashion to resolve the matter <br />or if efforts should be expedited. <br />Fahey noted the two citations that have been issued, and asked if the City <br />should wait for those to play out or if there are more efforts that can be <br />taken to compel compliance. <br />The City Attorney pointed out that the City can begin a civil proceeding to <br />seek an injunction to force removal of the building. He noted that the <br />criminal action does not get the problem resolved, which is removal of the <br />building. <br />Mr. Fahey introduced the following resolution and moved its adoption; <br />RESOI UTION NO. 2003-9-215 -DENYING TIIE VARIANCES <br />REQUESTED 13Y.IIM COSSACK FOR SIZE AND DIMENSION OF <br />A RECREATIONA7.13UILDING AT 42I ELI ROAD A.S <br />RECOMMENDED 13Y TIIE CITY PLANNER AND THE PLANNING <br />COMMhSSION AND I3A,SED ON THE FACT THAT THERE IS NO <br />HARDSHIP PRESENT TO WARRANT GRANTING THESE <br />VARIANCES <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Fahey, Blesener, Anderson, LaValle, Montour. <br />Nays (0). Resolution declared adopted. <br />Fahey felt that the next action for the Council to consider was to authorize <br />a court action to obtain an injunction for removal of the building. <br />Montour noted that Mr. Cossack also has the option to connect the <br />building to his House or reduce the size of the building.
