MINUTES
CITY COUNCIL
SEPTEMBER 24, 2003
that there are no footings under the recreational building, therefore,
footings would have to be added in order to attach it to the house. The
Planner agreed.
The City Administrator suggested that the City give Mr. Cossack a
deadline of the end of October to inform the City how he intends to
resolve the situation as well as require him to submit a timeline for doing
so. The Administrator pointed out that if Mr. Cossack plans to either
attach the recreational building or reduce its size, there will need to be
some sort of inspection plan worked out as there have been no building
inspections of this recreational building.
Fahey agreed that the City should obtain some commitment from Mr.
Cossack in writing, and suggested that that written commitment would
have to be submitted by the next Council meeting. Fahey felt that without
a commitment, the Council should then take action to pursue a court
action. Fahey suggested that in addition to the written commitment
outlining how he will resolve this matter, Mr. Cossack would have to
submit plans, specifications, and a timeline showing the feasibility of his
solution. Fahey felt this information would have to be submitted by the
end of October.
Anderson noted the two citations that have been issued and questioned
whether or not the City should be requesting a statement of Mr. Cossack's
intentions. The City Attorney indicated that he would have to look at that
issue, noting that the City has the option of either continuing or dismissing
the citations.
Anderson noted that the City's goal is to get this building in conformity
with the Codes or to have it removed. Anderson stated that he was not
opposed to any action that would get this result.
Montour noted that there are also the non-conforming posts on Mr.
Cossack's fence that have to be resolved.
Mr. Fahey introduced the following resolution and moved its adoption:
RESOLUTION NO. 2003-9-216 -INSTRUCTING CITY STAFF TO
REQUEST THAT MR. ,IIM COSSACK SUBMIT TO THE CITY A
WRITTEN STATEMENT OUTLINING, HIS` INTENTIONS FOR
RESOLVING THE LSSUE OF TIIE NON-COMPLIANT
RECREATIONAL. 73UII,DING ON HIS' PROPERTYAT 421 EI_I
ROAD AS WELL ASNON-COMPLIANT FENCE 73Y THE OC'TO13ER
K, 2003 COUNCIL MEETING, AND FURTHER REQUEST THAT
MR.
