MINUTES <br />CITY COUNCIL <br />SEPTEMBER 24, 2003 <br />debris removal as he had concerns about the placement of the debris from <br />the house demolition. The Administrator indicated that he would then <br />report the specifics to the Council. <br />Fahey pointed out that the contractor will still be owed for the cost of this <br />debris removal. The Administrator agreed, but asked that action on the <br />payment be delayed until he can investigate the matter in more detail. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOI. UTION NO. 2003-9-219 - TA73LING ACTION ON THE <br />CHANGE ORDER FOR MARKET PLACE DE73RIS REMOVAL, <br />PENDING A REPORT FROM TILE CITY ADMINLSTRATOR, AND <br />APPROVING PAYMENT OF THE PAY ESTIMATE FOR 2003 <br />IMPROVEMENTS IN THE AMOUNT OF $414, 450.95 <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5) LaValle, Fahey, Montour, Blesener, Anderson. <br />Nays (0). Resolution declared adopted. <br />i~AMEL The City Administrator reported that Rob Carlson, developer of the <br />ESTATES Hamel Estates project, has requested some wording changes to the <br />DEVELOPMENT development agreement. The Administrator reviewed these changes <br />AGREEMENT which include the limitation of the cost of storm sewer drainage <br />improvements related to directing run-off to 694 to be no more than the <br />cost of construction of an on-site ponding area and that revisions to the <br />grading and drainage plans will not necessitate a new Watershed permit. <br />The Administrator recommended approval of these wording changes as <br />requested, and informed the Council that in discussing the need for a new <br />permit from the Watershed, the Watershed indicated that while they would <br />review plan revisions, they would not require a new permit. <br />The Administrator indicated that one other issue the developer has raised <br />is the need to enter into Waivers of Right to Appeal Special Assessments <br />related to future road and watermain improvements in the Twin Lake area. <br />In calculating the amount of the proposed assessment ($37,166), the <br />Administrator indicated that the City considered how the property would <br />have been assessed if the Hamel Estates development had not been <br />proposed. Therefore, the assessment is based on the potential for four <br />watermain connections and three single-family lots. The assessment <br />amount was also inflated by three percent for four years. <br />The Administrator reported that it may be possible that watermain and <br />street improvements will occur in the Twin Lake area next year which <br />9 <br />
