MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 2003 <br />SALES TAX The City Administrator reviewed the Accounting Supervisor's report <br />ISSUE relative to uncollected sales tax on the water service charge for <br />commercial accounts, and the recommendation to back-collect this tax for <br />the past three years. The Administrator noted that the City will have to <br />remit the sales tax due for the past three years. By not collecting it from <br />the commercial accounts, other water users would be paying this cost. <br />The Administrator noted that under the IRS managed audit procedure, the <br />City would not be subject to interest or penalties for the unpaid sales tax. <br />Blesener asked about taxing the water service charge for residential <br />accounts. The City Administrator reported that residential water <br />consumption is tax-exempt while commercial is not. <br />Blesener requested a clarification of the wording in paragraph #2 of the <br />Managed Audit Agreement. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2003-11-2G3 -APPROVING THE MANAGED <br />AUDIT AGREEMENT WITH THE MINNESOTA DEPARTMENT OF <br />REVENUE AS RECOMMENDED 73Y CITY STAFF AND <br />AUTHORIZING TIIE MAYOR AND CITYADMINISTRATOR TO <br />EXECUTE THE AGREEMENT ON ]3EHALF OF THE CITY <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4) Blesener, Montour, LaValle, Anderson. <br />Nays (0). Resolution declared adopted. <br />SAVAGE The City Administrator reviewed the City Engineer's memo dated <br />LANE November 6, 2003 relative to three options for the reconstruction of <br />OPTIONS Savage Lane between Sextant Avenue and Demont Avenue. These <br />include the following: <br />L Full Reconstruction - 28-foot two-way street; <br />2. Full Reconstruction - 13-foot one way street; <br />3. Cul-de-sac of Sextant Avenue and East Brooks Avenue. <br />The Administrator indicated that it is staff's recommendation that option <br />two be pursued given the limited driveway accesses and traffic volumes <br />on the street. The Administrator reported that these options will be <br />presented to the impacted property owners at an upcoming neighborhood <br />meeting. Therefore, staff is requesting the Council's position on the <br />options presented. <br />10 <br />
