MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 2003 <br />Anderson stated that he sympathized with the Miller's and Grant's for not <br />wanting a road next to their lots. Anderson felt, however, that the Council <br />could not act on the vacation request without a more definitive plan for <br />providing access to the Fasciana property. <br />The City Administrator pointed out that the City Planner prepared the <br />thoroughfare plan for the area a couple of years ago as a planning tool for <br />the area. It would be shortsighted of the City to vacate Nadeau Road <br />without addressing the issue of access to the Fasciana property. <br />Anderson asked why Miller is proposing to locate the garage on the south <br />side of his house. Miller replied that that is where the previous garage <br />existed and there is still an existing driveway in that area. Miller felt that <br />he had the potential for a buildable lot on the north side of his house. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Montour, seconded by Blesener, the public hearing was <br />closed. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOI_UTIONNO. 2003-11-257-VACATINGNADEAU ROAD <br />LYING 73ETWEEN I3URKE L ANE AND CONDIT STREET <br />CONTINGENT UPON TIZE DEDICATION73Y THE MILLER'S OF <br />17 FEET OF RIGHT-OF-WAY FOR CONDIT STREET AS WELL. AS <br />25 FEET OF RIGHT-OF-WAY ON THE NORTH SIDE OF THEIR <br />PROPERTY FOR FUTURE ACCESS INTO THE FASCIANA <br />PROPERTY <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (3) Blesener, LaValle, Montour. <br />Nays (1) Anderson. Resolution failed due to the requirement of a 4/5'~"s <br />vote in support of the vacation. <br />VACATION LaValle opened the public hearing to consider the vacation of 10 feet of <br />OF PORTION Noel Drive right-of--way, which would reduce the right-of--way width for <br />OF NOEL Noel Drive from 60 feet to 50 feet. <br />DRIVE <br />RoberC Harris, 2707 Noel Drive, appeared before the Council requesting <br />approval of the vacation. Harris pointed out that he has begun an addition <br />to his garage that he learned is too closed to the existing right-of--way line. <br />4 <br />
