MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 2003 <br />The vacation of 10 feet of Noel Drive with 5 feet accruing to properties on <br />each side of the street will help to resolve this problem. <br />Montour pointed out that when Noel Drive was platted, the City standard <br />was for 60-foot rights-of--way. Since that time, the Code has been changed <br />to require 50 feet ofright-of--way for residential streets. <br />The City Administrator agreed that newly platted residential streets are <br />required to have 50 feet of right-of way. In addition, the City requires 5- <br />foot drainage and utility easements along lot lines. When Noel Drive is <br />reconstructed, the pavement will likely be reconstructed at 30 feet. A 50- <br />foot right-of--way would allow for 10-foot boulevards on either side of the <br />pavement. <br />LaValle noted the correspondence from Ramsey County indicating that <br />the accrual of an additional 5 feet of property to the abutting lots will not <br />have a significant impact on property taxes. <br />Montour asked the timing for reconstruction of Noel Drive, The City <br />Administrator anticipated that a neighborhood meeting would be held this <br />fall to discuss potential reconstruction. <br />Anderson asked how many other 60-foot right-of way widths there were in <br />the City and whether vacating 10 feet here would result in numerous <br />similar requests. <br />The Administrator indicated that the City has a number of residential <br />streets with rights-of--way greater than 50 feet. However, in the past, <br />property owners have not been eager to accrue this excess right-of--way to <br />their property. However, in this situation there may be double-fronting <br />lots that increase the potential for subdivisions. The Administrator noted <br />that vacation requests have always been considered on a case-by-case <br />basis. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Anderson, seconded by LaValle, the public hearing was <br />closed. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2003-11-258 -APPROVING THE VACATION OF <br />IO FEET OF RIGHT-OF-WAY FOR NOEL.
