<br /> <br />As shown above, both lots comply with applicable R-1 District lot area and width requirements. <br />Setbacks. As previously indicated, the applicant has no definite/confirmed plans for the two new lots. <br />However, it would be staff’s recommendation that approval of the lot split would be subject to any <br />future plans for these lots to be in compliance with R-1 standards for setback requirements at the time <br />of construction. <br /> Setback Requirement <br />Front Yard Not less than 30 feet <br />Side Yard 7 ½ feet <br />Rear Yard Not less than 30 feet <br /> <br />Easements. The certificate of survey submitted by the applicant does not currently show the 5 foot <br />perimeter drainage and utility easement around either of the lots. The applicant, as part of the final <br />approval, will submit a revised survey indicating the easements as required. <br />Park and Trail Dedication. As a condition of lot split, it is recommended that the new Lot 2 be subject <br />to the City’s park and trail dedication/cash contribution requirements of $3,500. <br />Grading, Drainage & Utilities. Issues related to grading, drainage and utilities should be subject to the <br />review and comment by the City Engineer. City staff is aware from the Public Works Director that <br />there are currently two water and sewer connections to the property. Therefore, city staff does not <br />expect any concerns with availability of city water or sewer connections as a result of the proposed lot <br />split. <br />Summary and Recommendation <br />The proposed lot split is consistent with applicable zoning and subdivision ordinance requirements. As <br />a result, Planning Staff recommends approval of the lot split at 2600 Spruce Street subject to the <br />following conditions: <br />1. The applicant removes all existing structures on the property prior to the commencement of any <br />new construction. <br /> <br />2. Future plans for either lot are subject to current code requirements and must comply with any <br />and all applicable codes. <br /> <br />3. The applicant will submit a revised certificate of survey showing drainage and utility easements <br />for both lots. <br /> <br />4. The City Engineer should provide comment and make a recommendation in regards to issues <br />related to grading, drainage, and utilities. <br />
