MINUTES <br />CITY COUNCIL <br />MARCH 9, 2016 <br />Montour introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2016-3-53 — A CCEPT THE 2016 TRASH AND <br />RECYCLING RATES AS SHOWN IN THE CITY <br />ADMINISTRATOR'S STAFF REPORT DATED MARCH 4, 2016 AND <br />UPDATE THE FEE SCHED ULE <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />SEXUAL <br />The City Administrator stated that the City Council has reviewed adopting <br />OFFENDERS <br />an ordinance that puts restrictions of where convicted Level III or higher <br />AND SEXUAL <br />sexual offenders could live to protect the City's citizens and children. He <br />PREDATORS <br />explained that the three snaps in the staff report show in green, the <br />ORDINANCE <br />residential areas that are outside of the 2,000 foot, 1,500 foot or 500 foot <br />radius distances from schools, church or place of worship, public park, <br />city easement, public wooded or open space or any public trails or public <br />fishing piers, or child care facility. He noted that the red circles on the <br />snaps show a 500 foot radius around all school bus stops, which further <br />reduces the available residential properties where an offender could live. <br />He stated that the 2,000 foot radius map leaves very little area where an <br />offender could live and the City Attorney is concerned that it is too <br />limiting. The City Administrator reviewed the 1,500 radius map and <br />stated that the City Attorney will likely think this is still too restricting. <br />He reviewed the 500 foot radius snap and stated Staff recommends <br />adopting this radius distance. He stated that the City Attorney feels the <br />500 foot radius is more reasonable and defensible. The City Attorney has <br />reviewed the proposed ordinance. The City Administrator noted the map <br />will be updated if any bus stops, public parks or easements, schools, <br />daycares or places of worship locations change, pending a request to <br />locate by a Level III offender. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2016-3-54 — ADOPTING AN ORDINANCE THAT <br />ADDS CHAPTER 2204, EXCLUSION ZONES AND PROHIBITION <br />OF CERTAIN EMPLOYMENT-RELATED ACTIVITIES WITH 500 <br />FOOT RADIUS DISTANCES TO THE CITY CODE, AS <br />RECOMMENDED BY THE CITYADMINISTRA TOR INHIS <br />MARCH 4, 2016 STAFF REPORT <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />6 <br />
