MINUTES <br />CITY COUNCIL <br />MARCH 23, 2016 <br />oversize garage, and asked the applicant if she was aware of that. Ms. <br />Wilsey stated she is agreeable to that requirement. <br />Compton Veeramallay, 2960 Thunder Bay Road, stated that these new <br />garages will face the rear of his property, but he has no problem with them <br />because they are attached garages. He stated there are so many trees on <br />the back of these lots that are eyesores because they are dying, have fallen <br />and are diseased. He explained that City Staff has told him that there is a <br />tree preservation code. The City Planner stated that diseased, dead, or <br />dying trees can be removed without any replacement requirements per the <br />code. The City Administrator stated some of the trees have been removed, <br />but when the plat was approved as many trees as possible were supposed <br />to be preserved for the existing neighbors. <br />Grant Johnson, realtor for developer, J.W. Moore, stated they are willing <br />to remove more trees. The City Administrator stated there were <br />commitments made to the neighbors to save trees and he will have to <br />review the developer's agreement to see if there were any legal <br />agreements made. Keis stated the neighbors should be notified if more <br />trees are going to come down. Mr. Johnson stated they will be replacing <br />the trees that are required to be replaced, and thinks they will be exceeding <br />the amount required. <br />Deana Veeramallay, 2950 Thunder Bay Road, explained they are only <br />complaining about the dead and fallen trees. She stated the living trees <br />can all remain, but it will not be known which trees are alive and healthy <br />until the leaves come in. <br />There were no other comments on this matter. <br />Upon motion by Keis, seconded by Montour, the public hearing was <br />closed. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 2016-3-61—APPROVINGA CONDITIONAL USE <br />PERMIT FOR A 1,274 SQUARE FOOT 0 VERSIZE A TTA CHED <br />GARAGE AT 2950 THUNDER BAY COURT WITH THE <br />CONDITIONS RECOMMENDED BY THE CITY PLANNER AND <br />PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Fischer. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />11 <br />
