MINUTES <br />CITY COUNCIL <br />JULY 27, 2016 <br />1. A certificate of survey will be submitted or evidence by locating <br />property corners will be required at the time of the building permit <br />application to verify that the new accessory structure complies with <br />setback requirements. <br />2. That within 30 days from the completion of the new accessory <br />structure, the existing shed is removed from the property. <br />3. That the accessory structure complies with all applicable building code <br />requirements. <br />Fischer asked the applicant what his intended use of the shed was. Bryan <br />Davis, 3115 Labore Road, stated he wants to add more storage for lawn <br />and garden equipment, and the current shed is in poor condition. He <br />stated that he has seen the staff report and agrees to the conditions stated. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Montour, seconded by McGraw, the public hearing was <br />closed. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION 2016-7-124 - APPROVING A CONDITIONAL USE <br />PERMIT TO ALLOW A SECOND DETACHED ACCESSORY <br />BUILDING AT 3115 LABORS ROAD, WITH THE CONDITIONS <br />STATED IN THE STAFF REPORT. <br />The foregoing resolution was duly seconded by Keis. <br />Aye (5). <br />Nays (0). Resolution declared adopted. <br />PUBLIC HEARING <br />Associate Planner stated that this request is for a Planned Unit <br />- PLANNED UNIT <br />Development Amendment to allow an adult daycare at 80 Little Canada <br />DEVELOPMENT <br />Road East, which is a multi -tenant building. She stated that the property is <br />AMENDMENT — <br />now zoned Planned Unit Development, but in 2013, the property was <br />ALLOW ADULT <br />zoned B-3, General Business and a conditional use permit was approved <br />DAYCARE -80 <br />for an adult day care use in the same space. She explained that tenant did <br />LITTLE CANADA <br />not move in to the building so the conditional use permit lapsed. She <br />ROAD E, SUITE 1, <br />noted that a proof of parking plan has now been submitted. The Associate <br />PAY SOUNG <br />Planned stated that Staff recommends approval with the following <br />conditions: <br />1. The proposed use meets the City's commercial district zoning <br />requirements for group day care and the property is developed in a <br />way that facilitates the use without significant modification. <br />3 <br />
