MINUTES <br />CITY COUNCIL <br />AUGUST 24, 2016 <br />amendment to be written in such a way that most other residents would not <br />be allowed to have chickens. <br />McGraw stated he is not in favor of urban farming or chickens, but <br />appreciates her approach. Fischer stated he hasn't had enough time to <br />really think about this, and isn't generally in favor of allowing chickens, <br />and doesn't want to open it up and set precedence. McGraw stated he also <br />needs a little time to think more, but is open to staff looking further into <br />this unique situation. Torkelson stated he is in favor of staff finding a <br />resolution for large lots, and possibly dealing with smaller lots later. There <br />was Council consensus to direct staff to look further in to this. Fischer <br />suggested tying a permit for chickens to the person versus the property. <br />PUBLIC <br />The City Planner stated that at the Planning Commission meeting, he <br />HEARING - <br />discussed the new law passed this spring that requires cities to allow <br />ORDINANCE 802: <br />temporary health care dwellings, unless the city takes action to opt -out of <br />OPT -OUT OF <br />the law by September t, 20M. He recommended that the City opt -out <br />REQUIREMENTS <br />since the law is written in a way that does not serve the interests of the City <br />FOR MINNESOTA <br />or the area population very well. He noted that if the City would like to <br />STATUTE <br />accommodate family healthcare housing needs, a future discussion can take <br />SECTION 462.3593 <br />place and details that are better suited for Little Canada could be added to <br />—TEMPORARY <br />the City Code. The City Planner stated that occasionally the City will get <br />FAMILY <br />asked if a second dwelling can be constructed, but the City Code does not <br />HEALTH CARE <br />currently allow that. He explained that people are told that their home can <br />DWELLINGS <br />be modified to accommodate family members. <br />The City Planner stated that he recommends adopting Ordinance 802, and <br />the Planning Commission voted unanimously in favor of opting out of the <br />requirements of Minnesota Statute 462.3593 for temporary family <br />healthcare dwellings. <br />There were no other comments from the general public on this matter. <br />Upon motion by McGraw, seconded by Keis, the public hearing was <br />closed. <br />McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION 2016-8-139 -ADOPTING ORDINANCE 802 THAT <br />OPTS OUT OF THE REQUIREMENTS OF MINNESOTA STATUTE <br />462.3593 FOR TEMPORAR Y TAMIL Y HEAL THCARE D WELLINGS. <br />The foregoing resolution was duly seconded by Keis. <br />Aye (4). <br />Nays (0).
