<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> <br />FROM: Joel Hanson, City Administrator <br /> <br />DATE: July 8, 2016 <br /> <br />RE: Sale of Public Works Garage – Revise Building Enhancement Incentive Completion <br />Date <br /> <br />Last Thursday, June 30th, we completed the sale of the former Public Works Garage located at 3100 <br />County Drive to Jim Schwalbach, dba 3100 Country Drive, LLC. Given the lengthy delays in closing <br />this transaction, Mr. Schwalbach has asked that we extend the deadline for application of the exterior <br />building enhancements incentive we provided as part of the sale package. The language in the <br />purchase agreement was as follows: <br />Exterior Enhancement Incentive: In consideration of the Buyer completing purchase of <br />the Property the Seller will provide Buyer with matching funds on a one to one (1:1) <br />basis for up to FIFTY THOUSAND AND 00/100 DOLLARS ($50,000.00) to offset the <br />costs of enhancing the building’s façade that is visible from Country Drive. This would <br />include enhancements to the exterior of the building, landscaping, or other exterior site <br />improvements, all of which are visible from Country Drive. This Incentive is subject to <br />the Buyer providing Seller with a work scope listing and cost estimates of sufficient <br />detail that presents a clear expectation of the work to be undertaken. Said work scope <br />and cost estimates must be approved by the Seller’s City Council, at their sole <br />discretion. Said funds shall be paid upon the Seller satisfying itself that the exterior <br />enhancements have been made and Buyer providing evidence that said exterior <br />enhancements have been paid for on or before August 31, 2016. <br />The request is to extend this date by one year, i.e. August 31, 2017. From Staff’s standpoint, this is a <br />reasonable request given we initially agreed to the basic terms of the sale last August, but title work <br />caused delays in closing. Therefore, staff recommends approval of a time extension until August <br />31, 2017 for the exterior building enhancements incentive for 3100 Country Drive and to <br />authorize the City Attorney to prepare any documents needed by the Buyer to achieve same with <br />the Mayor and City Administrator being authorized to execute same on behalf of the City. <br />cc: Jim Schwalbach <br />
