Resolution declared adopted. <br />Montour introduced the following resolution and moved its adoption: <br />RESOL UTION 2016-9-157 - APPROVING THE CONTIONAL USE <br />PERMIT TO ALLOW 46,000 SQUARE FEET OF OUTDOOR <br />STORAGE AT 3167 SPRUCE STREET, SUBJECT TO THE <br />CONDITIONS IN THE STAFF REPORT. <br />The foregoing resolution was duly seconded by McGraw. <br />Aye (5). <br />Nays (0). Resolution declared adopted. <br />PUBLIC <br />The City Planner stated that Tri-State Bobcat would like to redevelop the <br />HEARING- <br />former Bally's Fitness building at 71 Minnesota Avenue. He stated that <br />ARCHITECTURAL <br />Tri-State Bobcat currently has a location in Little Canada at 3101 Spruce <br />REVIEW, TEXT <br />Street in the Ryan Industrial Park, but they need more space and would like <br />AMENDMENT & <br />more visibility. He explained that in order to do this, the applicant will <br />REZONING AT 71 <br />need to rezone the property from the current B-3, General Business, to a <br />MINNESOTA <br />district that will both accommodate the proposed use, and continue to be <br />AVNEUE; TRI- <br />compatible with the surrounding land uses and the directions of the <br />STATE BOBCAT, <br />Comprehensive Plan. He noted that in order to accomplish this, the <br />BOB QUICK <br />applicants have applied to rezone the parcels to PUD, Planned Unit <br />Development, which would create a customized zoning district for this <br />user. The City Planner explained that the PUD district allows most of the <br />land uses allowed in other districts in the City, but excludes the service, <br />repair and sales of motor vehicles. He stated that the proposed business <br />will service and sell motorized construction equipment, some of which may <br />require licensing as motor vehicles. He explained that to clarify that this <br />exclusion will not prohibit the applicant's operation, an amendment to the <br />PUD district is being requested that would limit the excluded uses to motor <br />vehicles designated and licensed for operation on public roadways. <br />The City Planner stated the applicants propose to combine the two parcels, <br />extensively remodel the existing fitness building, add a screened open <br />storage enclosure along the east side of the property adjacent to the <br />Cobblestone Village townhomes, and add a landscaped display area along <br />the south side of the property adjacent to Minnesota Avenue. He stated the <br />property is currently almost entirely building and parking lot, but some of <br />the existing pavement will be converted to green space with more screening <br />added for the adjacent residential neighborhood.
