MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 8, 2016 <br />ARCHITECTURAL The City Planner stated that Tri-State Bobcat would like to redevelop the <br />REVIEW, TEXT <br />former Bally's Fitness building at 71 Minnesota Avenue. He stated that <br />AMENDMENT & <br />Tri-State Bobcat currently has a location in Little Canada at 3101 Spruce <br />REZONING AT 71 <br />Street in the Ryan Industrial Park, but they need more space and would <br />MINNESOTA <br />like more visibility. He explained that in order to do this, the applicant <br />AVNEUE; TRI- <br />will need to rezone the property from the current B-3, General Business, to <br />STATE BOBCAT, <br />a district that will both accommodate the proposed use, and continue to be <br />BOB QUICK <br />compatible with the surrounding land uses and the directions of the <br />Comprehensive Plan. He noted that in order to accomplish this, the <br />applicants have applied to rezone the parcels to PUD, Planned Unit <br />Development, which provides the potential for more flexibility. The City <br />Planner explained that the PUD district allows most of the land uses <br />allowed in other districts in the City, but excludes the service, repair and <br />sales of motor vehicles. He stated that the proposed business will service <br />and sell motorized construction equipment, some of which may require <br />licensing as motor vehicles. He explained that to clarify that this <br />exclusion will not prohibit the applicant's operation, an amendment to the <br />PUD district is being requested that would limit the excluded uses to <br />motor vehicles designated and licensed for operation on public roadways. <br />The City Planner stated the applicants propose to combine the two parcels, <br />extensively remodel the existing fitness building, add a screened open <br />storage enclosure along the east side of the property adjacent to the <br />Cobblestone Village townhomes, and add a landscaped display area along <br />the south side of the property adjacent to Minnesota Avenue. He stated <br />the property is currently almost entirely building and parking lot, but some <br />of the existing pavement will be converted to green space with more <br />screening added for the adjacent residential neighborhood. <br />The City Planner explained the use of this site for this purpose requires the <br />PUD zoning due to the industrial nature of the goods. He stated from a <br />land use perspective the Planning Commission needs to review if the <br />facility meets the Comprehensive Plan, and how does this facility fit into <br />the existing land use plan for the area, which is commercial and not <br />industrial. He noted that the applicant's proposal states that they are more <br />commercial than industrial, even though they sell products that are <br />typically considered industrial. He stated that Staff is suggesting a series <br />of conditions for this proposal, and staff feels that it is important to <br />address all of the land use transitions for the area. The City Planner <br />reviewed the list of items that Staff believes would be helpful in mitigating <br />potential negative impacts: <br />1.
