The City Council of the City of Little Canada hereby amends Chapter 600, <br />Section 602, Adoption by Reference of the Minnesota State Fire Code, by adding the underlined <br />material and deleting the stricken material as follows: <br /> <br /> <br />602. PROHIBITION OF CERTAIN OPEN FIRES ON BALCONIES <br /> <br /> <br />602.010. DECLARATION OF POLICY. On March 22, 2017, the Little Canada City <br />Council adopted the 2003 Minnesota State Fire Code including Appendix “H” 2015 Minnesota <br />State Fire Code including Appendix K relating to the prohibition of fires or barbecues on <br />balconies or patios. The purpose of this appendix is to prevent tragedies from occurring as a <br />result of such activities. <br /> <br />602.020. OPEN FLAME PROHIBITED. In any structure containing three or more <br />dwelling units, no person shall kindle, maintain, or cause any fire or open flame on any balcony <br />above ground level, or on any ground floor patio within 15 feet of the structure. <br /> <br />602.030. FUEL STORAGE PROHIBITED. No person shall store or use any fuel, <br />barbecue, torch, or other similar heating or lighting chemical or device in the locations <br />designated in Section 602.010. <br /> <br />602.040. EXCEPTIONS. Listed electric or gas-fired barbecue grills that are permanently <br />mounted and wired or plumbed to the building’s gas supply or electrical system and that <br />maintain a minimum clearance of 18 inches on all sides, unless listed for lesser clearances, may <br />be installed on balconies and patios when approved by the Fire Chief. <br /> <br /> <br />SECTION 4. The City Council of the City of Little Canada hereby amends Chapter 1400, <br />Section 1401, Burning Regulations, by adding the underlined material and deleting the stricken <br />material as follows: <br /> <br /> <br />1401. BURNING REGULATIONS <br /> <br /> <br />1401.010. PROHIBITED PERIODS. <br /> <br />(1) No persons shall kindle, ignite, set or start any outdoor fire for any purpose <br />whatsoever during any period which is designated by the City Council, Fire Chief, designee or <br />Minnesota DNR, as hazardous or dangerous. <br />
