MINUTES <br />CITY COUNCIL <br />AUGUST 9, 2017 <br />seems like every night would be an entertainment night in this case, and he <br />does not know how to differentiate the nights. Keis asked if the <br />entertainment license would address this. The City Administrator stated <br />that the entertainment license language as written, does not distinguish the <br />nights as intended. The City Attorney stated that in this case, we are <br />dealing with the numbers of people that distinguishes the difference in <br />nights. Mr. Duray stated there are less than 100 customers on Sundays <br />through Thursdays, and 250 customers on Fridays and Saturdays. He <br />explained that he is just asking to not have to wand and bag search on <br />Sundays through Thursdays. Montour stated that he does not want to have <br />to answer why the City did not require wanding on a Wednesday after a <br />customer came in and shot someone. He asked if the process could just be <br />streamlined for the slower nights. <br />Mr. Duray stated there are three security officers working Sunday through <br />Thursday, and at least 12 on weekends. The City Administrator stated that <br />the Council could agree on the conditions for the weekends and can <br />further discuss the rest of the week days. He stated that a provision could <br />be added to the conditions stating that the Council will further discuss the <br />Sunday through Thursday nights, and there were some other things to <br />modify. In regard to the provision dealing with noise from the deck area, <br />Mr. Duray stated he can leave the Plexiglas up on the upper deck all year <br />round to help cut down on noise for the neighborhood. <br />The City Administrator stated that the conditions in the agreement are for <br />Friday and Saturday nights, and the rest of the week nights will be <br />determined. Mr. Duray stated that the Building Official is determining <br />the load capacity and he would like the new numbers put in to the <br />agreement. The City Administrator explained that the new numbers may <br />be slightly higher, but the Council should realize that these capacity <br />numbers typically mean that the crowd is almost shoulder to shoulder, so <br />the numbers should be left as is in the agreement and possibly revisit it <br />down the road. Keis stated that he is uncomfortable with changing the <br />numbers now. Mr. Duray stated that he now has Ramsey County Sheriff <br />Deputies patrolling on Friday and Saturday nights from 11:00 p.m. to 3:00 <br />a.m., and it is working well even though it is a big expense for them. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION 2017-8-134 —APPROVING THE CONDITIONS AS <br />MODIFIED FOR THE HO GGSBREA TH LIQUOR LICENSE <br />The foregoing resolution was duly seconded by Montour. <br />Aye (5). <br />Nays (0).
