<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: October 16, 2017 <br /> <br />RE: Recording Extension <br /> Lot Line Adjustment – 2444 & 2446 McMenemy Street <br /> <br />Mark Chlebeck, Property Owner of 2446 McMenemy Street was approved a lot line adjustment to a <br />side property line shared by his lot and the neighboring property to the south at 2444 McMenemy <br />Street (Glenn Hageman, Property Owner) on May 24, 2017. Since that approval, Mr. Chlebeck has <br />worked with several realtors to obtain the documents necessary for the Ramsey County Recorder’s <br />office. However, this process is not yet completed. <br /> <br />Our city code states that an applicant has six months from the date of approval to record the <br />Subdivision or they need to request an extension to allow additional time. The following is the code <br />language for Subdivision Ordinance 1004 Procedures for Filing and Review, Section E: <br /> <br /> E. Recording Final Plat. If the final plat is approved by the City Council, the subdivider <br />shall record it with the Ramsey County Recorder within six (6) months after said approval or <br />approval of the final plat shall be considered void, unless a request for time extension is <br />submitted in writing and approved by the City Council prior to the expiration of the six (6) <br />month period. The subdivider shall, immediately upon recording, furnish the City <br />Administrator with a print and reproducible tracing of the final plat showing evidence of the <br />recording. No building permits shall be let for construction of any structure on any lot in said <br />plat until the City has received evidence of the plat being recorded by Ramsey County. <br /> <br />Based on this provision, Mr. Chlebeck is requesting a six month extension to complete this process. It <br />is city staff’s understanding that Mr. Hageman is in support of this request. City staff believes this <br />request to be reasonable and we do not have any concerns with the requested timeframe. As a <br />condition, city staff would request from Mr. Chlebeck an update after 60 days to verify progress in <br />completing this process. Therefore, city staff recommends approval of a six month extension to record <br />the documents with Ramsey County.
