<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: October 18, 2017 <br /> <br />RE: PUD Extension <br /> Precision Tree – 50 S. Owasso Boulevard <br /> <br />Precision Landscape and Tree at 50 South Owasso Boulevard was approved for a Rezoning to Planned <br />Unit Development and Subdivision of the property into two parcels on October 26, 2016. Their intent <br />was to build a new building on this newly created lot. The financing for this project and construction <br />of the new building was going to be handled through by RJ Marco. However, due to some serious <br />health issues for one of the principals, RJ Marco is unable to finance the project as originally planned. <br />In August, city staff had met with representatives from Precision Tree and RJ Marco because Mr. <br />Plowman was committed to trying to find an alternate option for financing that would still allow <br />Precision Tree to move forward with their approvals. To date, Precision Tree has been not been able to <br />secure another means for financing the project. They are working diligently to find an off-site location <br />for their outdoor storage that exceeds the 3,750 square feet of storage area that was approved for this <br />property in 2000. <br /> <br />Our city code states that an applicant has six months from the date of approval to record the <br />Subdivision or they need to request an extension to allow additional time. The following is the code <br />language for Subdivision Ordinance 1004 Procedures for Filing and Review, Section E: <br /> <br /> E. Recording Final Plat. If the final plat is approved by the City Council, the subdivider <br />shall record it with the Ramsey County Recorder within six (6) months after said approval or <br />approval of the final plat shall be considered void, unless a request for time extension is <br />submitted in writing and approved by the City Council prior to the expiration of the six (6) <br />month period. The subdivider shall, immediately upon recording, furnish the City <br />Administrator with a print and reproducible tracing of the final plat showing evidence of the <br />recording. No building permits shall be let for construction of any structure on any lot in said <br />plat until the City has received evidence of the plat being recorded by Ramsey County. <br /> <br />Additionally, our city code states that an applicant one year from the date of approval to commence <br />construction or they need to request an extension to allow additional time. The following is the code <br />language for Ordinance 923 PUD, Administration, Section D.4: <br /> <br /> 4. Limitation on Final Plan Approval. Within one (1) year after the approval of a Final Plan <br />for PUD, or such shorter time as may be established by the approved development schedule, <br />construction shall commence in accordance with such approved plan. Failure to commence <br />construction within such period shall, unless an extension shall have been granted as
