MINUTES
CITY COUNCIL
OCTOBER 25, 2017
not completed the work. She reported that staff is supportive of giving a
six month extension to Mr. Chlebeck.
Marls Chlebeck, 2446 McMenemy Street, stated that he has had problems
finding someone to complete the process for him, so he needs the
extension.
Keis introduced the following resolution and moved its adoption:
RESOLUTIONNO. 2017-10-199 APPROVINGA 6MONTH
EXTENSION FOR MARK CHLEBECK, 2446 MCMENEMY STREET,
TO RECORD THE LOT LINE ADJUSTMENT DOCUMENTS WITH
RAMSEY COUNTY
The foregoing resolution was duly seconded by Montour.
Ayes (5).
Nays (0). Resolution declared adopted.
LAPSE OF
The Associate Planner explained that Precision Landscape & Tree at 50
PLANNED UNIT
South Owasso Boulevard had received approval on October 26, 2016 for a
DEVELOPMENT
rezoning and subdivision with the intention of constructing a new building
APPROVAL FOR
on the newly created lot. She stated that the financing for this project was
PRECISION
going to be handled by RJ Marco, but due to a serious health issue by one
LANDSCAPE &
of the principals, RJ Marco is now unable to finance the project as
TREE, 50 SOUTH
originally planned. She explained that the City Code states that an
OWASSO
applicant has six months from the date of approval to record the
BOULEVARD
subdivision, and one year to commence construction in a planned unit
development.
The Associate Planner reported that staff met with Precision Tree and RJ
Marco in August and they are trying to find an alternative option for the
financing. She noted that to date, Precision Tree has not been able to
secure another means for financing the project. Staff feels it is reasonable
to give a one year extension, with the condition that the applicant gives
City Staff an update on their progress every 90 days. She noted that
Precision Tree has recently found an off-site temporary outdoor storage
location in order for their property to become city code compliant.
Keis stated that Precision Tree has had a year to get their outdoor storage
into compliance, and they have done little to address it in that time. He
asked if they can be required to get into compliance within 60 days and if
they do not, then revolve their conditional use permit. The City
Administrator stated that an option would be to give them 60 days to get in
0
