MINUTES
CITY COUNCIL
MAY 22, 2002
Mr. Fahey introduced the following resolution and moved its adoption:
RESOI UTION NO. 2002-5-/23 - ACCF,PTING S'/'AF'F'b'
RF.COMMENDATTON RELATNE TU THE l~ADNAIS HEIGHTS
HISTORICAL. Resolution declared adopted.
R>JGULATION The Fire Chief appeared before the Council and recommended that the City
O~ FIREWORKS enact an ordinance regulating the sale of fireworks. The Chief presented the
SALLS Council with a draft ordinance for their review. Anderson suggested some
modifications to Sections 4. I (language appears missing), 4.8 (storage issues),
and 5.1 (reference to public assembly is overly broad) as contained i^ the draft.
Montour asked if any of the surrounding cities were considering similar
ordinances. "1'he Chief replied that many are. The Chief also noted that the
main concern is with the storage of fire works and the resulting fire load that
this storage has. The Chief also pointed out that the draft ordinance would
I>rohibit the use of fireworks in any of the City's parks or at places of public
gathering. The concern is with the exposure of other people to these
fireworks. Fahey noted that sparklers and other fireworks would create a mess
in the parks as well as a hazard given that people are likely to discard wires on
the gI'OLI I1d.
Council felt the City Attorney should review the draft ordinance and put it into
the proper format. In the meantime, a moratorium should be put in place
prohibiting the sale of fu~eworks in the City until a regulating a'dinance is
adopted.
Mr. Fahey introduced the following resolution and moved its adoption:
RESOI UT/ON NO. 2002-5-]24 - D/RECT'/NG THF' CITYATTORNEY
TO PREPARE AN APPROPRIATE FIREWORKS REGULATING
ORDINANCE AS D/.SCUSSED AND /N(.`LUDING TF/E COMMENTS OI%
COUNCIL, MEMBER ANDER.40N
i'he foregoing resolution was duly seconded by Scalze.
Ayes (5) Fahey, Scalze, Anderson, Montour, LaValle.
Nays (0).
