MINUTES <br />CITY COUNCIL <br />SEPTEMBER 25, 2002 <br />SIIERMAN Mr. Fahey introduced the following resolution and moved its adoption: <br />DEVELOPMENT <br />AGREEMENT RESOLUTION NO. 2002-9-22I -CAL LING FORA .SPECIAL. <br />MEETING ON MONDAY, OCT013ER 7, 2002 AT 5 P.M. TO REVIEW <br />AND ACT UPON A PROPOSED DEVELOPMENT AGREEMENT <br />WITH SHERMAN ASSOCIATES' A.S' RECOMMENDED 13Y THE <br />CITYADMINISTRATOR <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Fahey, Scalze, Montour, LaValle, Anderson. <br />Nays(0). Resolution declared adopted. <br />DEFINITION Mayor Fahey opened the Public Hearing to consider an amendment to <br />OF SINGLE- the Zoning Code relating to the definition of"Single-Family" and <br />FAMILY AND "Dwelling Unit" as proposed by the City Planner. Fahey noted that the <br />DWELLING Planning Commission recommended approval of the amendment as <br />UNIT proposed. <br />Fahey asked if the term "cooking area" was defined anywhere in the Code. <br />The City Planner replied that it was not. Consensus was that this terms <br />should be defined, and the City Planner indicated that he would put a <br />definition together defining a cooking area as one that has a sink, oven, <br />refrigerator, etc. <br />Anderson asked about the rental of a home to a bunch of college students, <br />for example. Anderson pointed out that there may be one cooking area, <br />however, could be eight unrelated individuals living in a residence. <br />The City Planner indicated that the Code defines families and also allows <br />up to two unrelated people living in asingle-family residence. <br />There was no one present wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Montour, the public hearing was <br />closed. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RES`OL UTION NO. 2002-9-222 -ADOPTING THE ZONING CODE <br />AMENDMENT RELATING TO THE DEFINITIONS OF "SINGLE- <br />FAMILY" AND "DWELLING UNIT" AS WELL AS INSTRUCTING <br />THE CITY PLANNER TO INCL. UDE A DEFINITION OF <br />"COOKING UNIT" AS DISCUSSED <br />19 <br />
