He also noted that there maybe circumstances where a policy was not <br />feasible, and pointed out that under a policy it would not be necessary to go through a <br />variance process. <br />Fahey stated that if a policy is adopted, he did not support excluding property <br />divisions of three lots or less. Fahey felt a policy should apply to all plats or <br />subdivisions, but not to existing lots of record. Fahey felt that adoption of a 50-foot <br />policy would not preclude reasonable development. <br />Scalze pointed out the necessity for the policy based on the new knowledge that has <br />been gained and the age of the existing pipeline. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2002-20-232 - ADOPTING A SO-FOOT PIPELINE <br />SETBACK SAFETY POI ICY TO 13E APPLIED TO ALL. PLATS AND <br />SU73DIVISIONS IN A REASONABLE AND PRACTICAL FASHION FROM <br />THE DATE OF PASSAGE OF THIS RESOLUTION, NOTING THAT THE <br />POLICY WOULD NOT APPLY TO EXISTING LOTS OF RECORD AND THE <br />RE-ESTABLISHMENT OF.STRUCTURES ON EXISTING LOTS OF RECORD, <br />AND INDICATING THAT THE POLICY IS A REASONABLE ONE AND WII_I_ <br />ADVANCE PU73LIC SAFETY <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (3) Fahey, Scalze, Anderson. <br />Nays (1) Montour. Resolution declared adopted. <br />Fahey suggested that the developer be directed to show the location of the pipelines <br />as well as the pipeline easement on the proposed plat so that the City can measure tlxe <br />conformity to the pipeline setback policy. <br />The City Administrator indicated that the developer is showing selected locations of <br />the pipeline. He also noted that staff s recommendation is that the road be moved off <br />the pipeline easement, and that the easement must be defined and shown on the plat. <br />In terms of a blanket easement, the developer has been informed that the easement <br />area slxould be defined and releases of excess easement obtained from Williams <br />Pipeline. The Administrator informed the Council that the impact of the policy on <br />The Preserve plat would be the loss of one lot at the end of the cul-de-sac. <br />Fahey agreed that as part of the preliminary plat the City must have a clearly <br />delineated easement area, and noted the Administrator's comments that staff has <br />communicated this to the developer. <br />
