OF <br />A BRICK CASING IN THE SPRING AS DISCUSSED THIS EVENING <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Fahey, LaValle, Anderson, Montour. <br />Nays (I) Scalze. Resolution declared adopted. <br />PRELIMINARY Mayor Fahey opened the continuation of the Public Hearing <br />PLAT FOR relative to the preliminary plat for The Preserve. It was noted <br />THE that the Planning Commission has recommended approval of the <br />PRESERVE preliminary plat subject to compliance with the recommendations of the City Plamier, <br />City )/ngineer, City Administrator, as well as compliance with the City's 50-foot <br />pipeline setback policy. <br />Jeff McDonell, PiroTerra Design, appeared before the Council and presented the <br />preliminary plat. McDonell presented a diagram that showed the Williams Pipeline <br />easement through the area. He reported that this easement has been verified by Meri o <br />Land Surveying and title work will be submitted relative to the easement. McDonell <br />indicated that there has been conversation about the easement on some of the Viking <br />Drive properties extending to the north onto the Palmen property. McDonell <br />presented an e-mail from Liz Babcock of Williams Pipeline confirming that the <br />easements on these Viking Drive properties do not extend onto the Palmen property. <br />The Williams Pipeline easement does, however, extend onto the Palmen property at <br />the western end of the proposed plat. McDonell reported that the easement is <br />centered on one of the 6-inch lines. He also noted that they have moved the proposed <br />Preserve Court so that the pavement is off the easement at the western edge of the <br />plat. The curbing would touch the easement line. McDonell estimated that the <br />curbing would touch the easement for a distance of approximately three lots. He has <br />recalculated his estimate for road replacement should Williams need to disturb this <br />area and estimates replacement costs at $10,000. <br />McDonell presented three diagrams showing the location of the pipeline in relation to <br />the development and depicting the area that would need to be disturbed should <br />Williams need to repair the pipeline in these areas. McDonell began with a diagram <br />of the pipeline at the eastern end of the plat. He showed that using a 2 to 1 slope, the <br />area of disturbance would not reach the proposed road. McDonell also reported that <br />there are three pipes through this area. One is a 6-inch abandoned line that was <br />abandoned because it was old. The other is a 6-inch line being used by World Com. <br />And the Third is a 12-inch active line that is approximately 50 years old. <br />4 <br />
