MINUTES <br />CITY COUNCIL <br />NOVEMBER 13, 2002 <br />through the parking lot and caused excessive surface wear. This resulted in the need <br />to sealcoat the parking lot. <br />Anderson asked if the City could hold the contractor responsible for this damage. <br />The City Administrator reported that the contract with Palda & Sons has been closed <br />out. However, there may be some recourse available under the Minnesota Valley and <br />Sunram contracts. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RE.S'Ol. UTION NO. 2002-II-263 -TABLING ACTION ON THE IRRIGATION <br />SYSTEM AND SEALCOATING SETTLEMENT FOR THUNDER 73AY PLAZA <br />AND ROUND LAKE MAIL PENDING A MORE DETAILED REPORT 73Y THE <br />PU737.IC WORKS DIRECTOR AT THE NOVEMBER 20, 2002 COUNCIL. <br />MEETING <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (3) Montour, Scalze, Anderson. <br />Nays (0). Resolution declared adopted. <br />THE The City Administrator reviewed the letter sent to the City by the attorney <br />PRESERVE representing the developers of The Preserve plat. The Administrator also noted his <br />response to that letter and asked the Council for their comments relative to his letter. <br />The City Attorney noted that the letter from The Preserve's attorney was not sent to <br />him. The City Attorney felt that the City Administrator's response letter was <br />appropriate. He also noted that the five-day deadline referred to by the developer's <br />attorney is a mythical deadline. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RE.SOL UTION NO. 2002-11-264 -DIRECTING THE CLTYADMINISTRATOR <br />TO FORWARD HIS RECOMMENDED RESPONSE LETTER TO THE <br />ATTORNEY REPRESENTING THE DEVELOPERS OF THE PRESERVE <br />The foregoing resolution was duly seconded by Anderson. <br />Ayes (3) Montour, Anderson, Scalze. <br />Nays (0). Resolution declared adopted. <br />14 <br />
