MINUTES CITY COUNCIL NOVEMBER 13, 2002 through the parking lot and caused excessive surface wear. This resulted in the need to sealcoat the parking lot. Anderson asked if the City could hold the contractor responsible for this damage. The City Administrator reported that the contract with Palda & Sons has been closed out. However, there may be some recourse available under the Minnesota Valley and Sunram contracts. Mr. Montour introduced the following resolution and moved its adoption: RE.S'Ol. UTION NO. 2002-II-263 -TABLING ACTION ON THE IRRIGATION SYSTEM AND SEALCOATING SETTLEMENT FOR THUNDER 73AY PLAZA AND ROUND LAKE MAIL PENDING A MORE DETAILED REPORT 73Y THE PU737.IC WORKS DIRECTOR AT THE NOVEMBER 20, 2002 COUNCIL. MEETING The foregoing resolution was duly seconded by Scalze. Ayes (3) Montour, Scalze, Anderson. Nays (0). Resolution declared adopted. THE The City Administrator reviewed the letter sent to the City by the attorney PRESERVE representing the developers of The Preserve plat. The Administrator also noted his response to that letter and asked the Council for their comments relative to his letter. The City Attorney noted that the letter from The Preserve's attorney was not sent to him. The City Attorney felt that the City Administrator's response letter was appropriate. He also noted that the five-day deadline referred to by the developer's attorney is a mythical deadline. Mr. Montour introduced the following resolution and moved its adoption: RE.SOL UTION NO. 2002-11-264 -DIRECTING THE CLTYADMINISTRATOR TO FORWARD HIS RECOMMENDED RESPONSE LETTER TO THE ATTORNEY REPRESENTING THE DEVELOPERS OF THE PRESERVE The foregoing resolution was duly seconded by Anderson.
