MINUTES <br />CITY COUNCIL <br />JULY 23, 2008 <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL UTION N0.2008-7--176 -TABLING ACTION ON THE <br />APPLICATION FOR PROPERTY DIVISION OF 580 AND 588 EAST <br />COUNTY ROAD B-2 INTO THREE LOTS AS REQUESTED BY MR. <br />GENE LAVAQUE D UE TO DIFFICULTIES IN OBTAINING A <br />PERMIT TO CONSTRUCT A DRIVEWAY OVER THE MAGELLAN <br />PIPELINE UNTIL SUCH TIME AS MR. LAVAQUE REQUESTS <br />THAT THE PROPERTY DIVISION BE CONSIDERED, AND <br />INDICATING THAT THE PROPERTY DIVISION WILL BE <br />DEEMED TO BE DENIED UNLESS A 60-DAY WAIVER IS SIGNED <br />BY THE APPLICATIONS BASED ON THE FOLLOWING <br />FINDINGS OF FACT: <br />o THE APPLICANTS WERE NOT PRESENT AT THIS <br />EVENING'S COUNCIL MEETING; <br />o IT WAS NOT POSSIBLE FOR THE COUNCIL TO ASK <br />ANY QUESTIONS OF THE APPLICANTS AND <br />OBTAIN COMPLETE INFORMATION; <br />o BASED ON THE CONCERNS EXPRESSED TO THE <br />COUNCIL VIA A JULY 10, 2008 LETTER TO THE <br />COUNCIL FROM THE PROPERTY OWNERS AT 627 <br />EAST VIKING DRIVE <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />PRELIMINARY Mayor Blesener opened the Public Hearing to consider a Preliminary Plat <br />PLAT AND and Planned Unit Development Amendment to provide for the <br />PUD redevelopment of an existing strip mall into a CVS Pharmacy at the <br />AMENDMENT- northwest corner of Rice Street and county Road C as requested by <br />CVS Velmeir Construction Services. It was noted that the City Planner and <br />PHARMACY the Planning Commission recommended approval subject to conditions. <br />The City Planner reported that in reviewing the CVS proposal, there were <br />three major issues that were discussed by the Planning Commission. The <br />first related to the yellow color proposed on the CVS building. It was the <br />recommendation of the Planning Commission that this color be changed to <br />a taupe. The second issue related to the entrance on County Road C, and <br />the Commission recommended that the County Road C access be moved <br />further east with a 40 foot separation being maintained between this <br />entrance and the veterinary clinic access. The Planner noted that there <br />was extensive discussion related to site circulation between the north <br />
