MINUTES <br />CITY COUNCIL <br />JULY 23, 2008 <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Montour, seconded by Allan, the public hearing was <br />closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2008-7--177 -APPROVING THE PRELIMINARY <br />PLAT AND THE PLANNED UNIT DEVELOPMENT TO PROVIDE <br />FOR THE REDEVELOPMENT OF THE RICE AT C CENTER INTO <br />A CVS PHARMACYAS PROPOSED BY VELMEIR CONSTRUCTION <br />SERVICES SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER, THE CITY <br />ENGINEER, AND THE PLANNING COMMISSION, SUBJECT TO <br />THE EXTERIOR DESIGN OF THE CVS BUILDING HAVING THE <br />ARCHED DESIGNAS DISCUSSED, SUBJECT TO THE ADDITION <br />OF SIDEWALKS ALONG RICE STREET AND COUNTY ROAD C <br />WITH SIDEWALK INSTALLATION TO BE COORDINATED WITH <br />RAMSEY COUNTY, AND SUBJECT TO THE ADDITION OF <br />ORNAMENTAL FENCING IF DETERMINED FEASIBLE <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />CUP & Mayor Blesener opened the Public Hearing to consider the application for <br />VARIANCE - Conditional Use Permit allowing outdoor storage of storage containers as <br />53 well as a Variance to allow more than four (4) storage containers at 53 <br />WOODLYN Woodlyn Avenue for On-Site Air Temp, Inc. It was noted that the <br />AVENUE - Planning Commission recommended approval based on the findings <br />ON-SITE outlined in the City Planner's report, subject to the containers being <br />AIR TEMP painted to match the building and being kept in good repair, and subject to <br /> the recommendations of the Fire Marshal as outlined in his July 7, 2008 <br /> report. <br />The City Planner indicated that On-Site Air currently has 8 storage <br />containers on their property. Only one of these containers is visible from <br />Woodlyn Avenue. He noted that the current Code allows a maximum of 4 <br />containers, and On-Site Air is requesting up to 11. On-Site Air's position <br />is that the number of containers allowed should be based on a percentage <br />of the property rather than a flat number. In previous discussions of this <br />issue a 5% figure was considered, but the Council limited the maximum <br />number of containers to 4. Utilizing the 5% figure, On-Site estimates that <br />
