Zoch reporrted that she did not find out until two years ago that the <br />l3 feet was taken rather than the 8.5 feet. Zoch also indicated that it was her <br />widerstauding that the right-of way would be an easement, therefore, her <br />property line would not change. However, she found out that this was not the <br />case. <br />The City Administrator reported that he has reviewed Che Yorkton plat and <br />noted that Mr. and Mrs. Loch signed the plat which dedicated the right-of--way <br />that is being discussed. <br />Mrs. Zoch again pointed out that 13 feet was taken rather than the 8.5 feet <br />discussed by the Council. Mrs. Zoch asked if they can get the 5 feet of right- <br />of-way retwned to them. <br />Fahey noted that the question is how the street lines up not and what makes <br />sense. Fahey pointed out that when Mr. Bougie subdivides his property it may <br />be appropriate to take the additional right-of way needed so that the City has <br />the standard 50 feet of right-of=way needed for a residential street. Fahey <br />noted that the City Administrator has indicated that given the alignment of <br />Condit it would be appropriate to take this right-of--way fi'om the Bougie <br />property. <br />Zoch suggested that some of the additional right-of--way needed should come <br />from the east side of the sheet from the properties which are being developed. <br />Fahey noted that R. J. Marco Construction has expressed a willingness to <br />dedicate right-of--way. Fahey again noted the need for 50 feet ofright-of--way <br />for residential streets. <br />Mrs. Zoch suggested that it was illegal that 73 feet of right-of--way was taken <br />from her property when the indication was 8.5 feet would be taken. Fahey <br />pointed out that if the Zoch's signed the plat, then the taking of this right-of- <br />way was legal. Fahey noted that he does not know what discussions took place <br />between the Zoch's and Larry Lee at the time of the platting of this area. <br />Mrs. Zoch indicated that she thought her corner lot would be 140 feet in depth <br />and the plat indicates 1 12 feet. She noted that this lot does not meet the City's <br />minimum standards. loch reported that she has requested a letter from the <br />City indicating that the lot is buildable, but was never given such a letter. <br />Fahey noted that the lot is a lot of record and would be buildable. <br />Scalze pointed out that the right-of--way for Condit Street will have to line up. <br />
