MINUTES <br />CITY COUNCIL <br />OCTOBER 10, 2001 <br />taxes. Certified assessments will be spread over aten-year period at a 6.75% <br />interest rate. <br />Mr. James Gregor, 107 Australian Avenue, presented the Council with a <br />written objection to his assessment. <br />Montour asked why estimated actual costs were quite a bit lower than the <br />feasibility estimates. The City Engineer reported that due to the competitive <br />bidding market, bids were very favorable. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 200I-10-ZI9-ACKNOWLEDGING RECEIPT OF <br />THE WRITTEN OB.IECTION TO AS.S`ESSMENT SUBMITTED I3Y.IIM <br />GREGOR, 107 A USTRAL IAN AVENUE <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5) LaValle, Fahey, Scalze, Montour, Anderson. <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that the City's assessment policy was <br />followed in calculating assessments to the properties benefiting by this <br />improvement. <br />The City Engineer noted that Mr. Gregor is listing concerns with regard to his <br />driveway as one of his objections to the assessment. The Engineer indicated <br />that he was not aware there was a concern. Gregor indicated that the driveway <br />apron was poured improperly. Previously his driveway apron consisted of one <br />panel. It was repoured as four panels, and he had a concern with the alignment <br />of the jointing in these four panels. Gregor reported that he discussed his <br />concerns with the project manager who indicated that the contractor was not <br />willing to correct the problem. The City Engineer indicated that he would <br />meet with Gregor on his property to review the situation. If the apron needs to <br />be repoured, it will be. The Engineer noted that the City has held a retainage <br />amount to ensure that all punchlist items and concerns such as this are <br />addressed. <br />Gregor's objection also raised an issue with the alignment of the pavement for <br />Australian within the street right-of--way. Gregor indicated that it was his <br />understanding that there was to be 5 foot ofright-of--way on either side of the <br />pavement. However, the way the street and cul-de-sac are aligned there is <br />approximately 3 '/z feet ofright-of--way abutting his property. <br />The City Engineer reported that given the configuration of the cul-de-sac, it <br />was necessary to adjust its placement within the right-of--way.
