MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 2001 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Fahey, Montour, Anderson. <br />Nays (0). Resolution declared adopted. <br />SCHMIT/KERB/ The City Administrator requested that the Council authorize staff to obtain <br />SPROSTY easements and execute a revised drainage agreement with Mr. Schmit, Mr. <br />DRAINAGE and Mrs. Kerr, and Mr. and Mrs. Sprosty for a drainage pond on their <br />AGREEMENT properties. The Administrator noted that the pond would be owned by the City <br />and the agreement would indemnify the City if there is a drainage event that <br />exceeds the capacity of the pond. The pond would be designed to replace what <br />previously existed. He noted that the City is not guaranteeing it will address <br />all drainage concerns in every storm event. He indicated that storm sewer <br />systems are generally designed fora 10-year event and are subject to flooding <br />in bigger storms. The Administrator also noted that the property owners have <br />agreed to help the City with maintenance of the banks of the ponding area. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2001-10-249 -AUTHORIZING CITY STAFF TO <br />013TAIN THE APPROPRIATE EASEMENTS FOR THE <br />SCHMIT/KERR/SPROSTY POND AS WELL AS APPROVING A <br />REVISED DRAINAGE AGREEMENT AND AUTHORIZING THE <br />MAYOR AND THE CITYADMINISTRATOR TO EXECUTE THAT <br />AGREEMENT ON I3EFIA1_F OF THE CITY <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Fahey, Scalze, Montour, LaValle, Anderson. <br />Nays (0). Resolution declared adopted. <br />CODE Scalze expressed concern regarding a recent fire in the Rice Street area <br />ENFORCEMENT and her concern that a public safety hazard exists in this area and possibly <br />others given the outdoor storage and storage in trailers that is occurring, and <br />the fact that a tower exists in this area that is located approximately two feet <br />from a building. Scalze suggested that the Council ask for information from <br />the Fire Marshal, Fire Department, and Code Enforcement Officer on these <br />issues. LaValle suggested that a workshop be called to discuss the concerns <br />raised by Sca]ze. <br />The City Administrator acknowledged that there are a number of properties in <br />the City that have serious code violations. He pointed out that the issue is <br />likely one of time management with regard to resolving the most serious code <br />violations first.
