MINUTES <br />CITY COUNCIL <br />FEBRUARY 23, 2000 <br />Road was an informal access. However, the property owner indicated that <br />they do have an easement for their driveway. <br />Alex Klidzejs, 3244 Twin Lake Road, pointed out that Mitchell Trail is <br />not improved. However, there is a blacktopped driveway over the right- <br />of-way for access to 3244 Twin Lake Road. Klidzejs reported that the <br />utility easement to the lake is quite steep, and suggested that during wet <br />conditions it would be difficult to get a truck over that easement to access <br />the sewer line. He felt that access to the sewer line would be weather <br />dependent in this area. Klidzejs pointed out the new house being <br />constructed on 3240 Twin Lake Road and indicated that the additional <br />easement the Public Works Director is requesting would be quite close to <br />the new house. <br />Fahey noted that the City cannot be weather dependent on gaining access <br />to a sanitary sewer line. That is the reason the Public Works Director is <br />recommending a gravel road be installed to access the sewer line. <br />Klidzejs suggested that driving a big truck on the access road would rip up <br />the road if conditions were not right. Fahey noted that the City would be <br />responsible for the repair and maintenance of the access. <br />Scalze suggested that the Klidzejs property should not have been allowed <br />to development without the improvement of Mitchell Trail. Morelan <br />agreed, but pointed out that the property has been developed, and it would <br />not be feasible to improve Mitchell Trail to serve one home. Fahey <br />suggested that development of the lots at 3240 Twin Lake Road should be <br />subject to a restrictive covenant that these lots cannot use Mitchell Trail <br />for access. It was suggested, however, that the right-of--way for Mitchell <br />Trail be retained. <br />It was noted that since the Planning Commission has tabled action on this <br />matter until their March meeting, that the Council can take no action <br />pending a recommendation from them. <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />RF.SOI. UTION NO. 2000-2-40 - TA737.ING ACTION ON THE <br />APPLICATION FOR PROPERTY DIVISION OF 3240 TWIN LAKE <br />ROAD PENDING A RECOMMENDATION FROM THE PLANNING <br />COMMISSION <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) Morelan, Scalze, Fahey, Pedersen. <br />Nays (0). Resolution declared adopted. <br />
