MINUTES <br />CITY COUNCIL <br />FEBRUARY 23, 2000 <br />HALL FOR MILLENNIUM CHARITY PLUS FOR THE LICENSE <br />PERIOD APRII. I, 2000 THROUGH MARCH 3Z, 2002 <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (4) Morelan, Fahey, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />MGM LIQUOR The Council reviewed MGM's liquor license violation wherein they <br />LICENSE sold liquor to a retail establishment that was on the State's tax delinquent <br />VIOLATION list. It was noted that the State imposed a $200 fine, which MGM has <br />paid. The City's ordinance requires that the Council take action to either <br />suspend or revoke the license or impose a fine. <br />Jack Lanners, FTL Corporation dba MGM Liquor Warehouse, reported <br />that State Law prohibits retail establishments to sell liquor to another <br />retail establishment. It also prohibits the sale of liquor to any <br />establishment on the State's tax delinquent list. Lanners reported that as <br />an off-sale liquor store, MGM is not provided with a listing of the retail <br />businesses that are tax delinquent. This listing is, however, provided to <br />wholesale establishments. As a result, MGM would not be aware of <br />whether or not a business was tax delinquent. MGM would also not be <br />aware of whether a business owner coming into their liquor store was <br />purchasing liquor for their own personal use or for the business. <br />Based on the information provided by Mr. Lanners, it was the consensus <br />of the Council felt that the fine imposed by the City should be minimal. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2000-2-42 - IMPOSING A $I FINE ON MGM <br />LIQUOR WAREHOUSE FOR THEIR RECENT L IQUOR LAW <br />VIOLATION <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (3) Fahey, Pedersen, Scalze. <br />Nays (1) Morelan.
