The Planner pointed out that given the nature of the home <br />occupation, he is recommending aone-year time limit for it to continue to <br />allow the applicant an opportunity to relocate the business to a suitable <br />commercial location. Another option would be to allow the business to <br />continue without a permit for a specific period of time to allow it an <br />opportunity to relocate. If relocation does not occur, the problem would <br />become an enforcement issue. <br />Scalze asked if the Council is required to grant a permit if the home <br />occupation does not fit within the code. <br />The Zoning Administrator reported that the issue came up because of <br />complaints about traffic congestion at the intersection of Jackson Street <br />and Rose Place. It was observed that part of the problem was on-street <br />parking that was occurring as a result of the Bixby home occupation. The <br />Zoning Administrator reported that she contacted the Bixby's to discuss <br />the problem. It was discovered that Mr. Bixby has had a home occupation <br />for the past 20 years. However, the business has been expanding, and Mr. <br />Bixby realizes it is time to move the business to a commercial location. <br />He is currently in the process of trying to find commercial property. <br />Scalze pointed out that Bixby does not have to purchase property, he could <br />rent it. It would take less time to relocate if Mr. Bixby found rental <br />property. <br />Sue Tako, 146 E. Rose Place, also questioned the one-year time period <br />that the Planner was recommending for the Special Use Permit. Tako <br />pointed out the congestion problem at the intersection of Jackson Street <br />and Rose Place. Tako stated that she would prefer that the Council give <br />Mr. Bixby six months to relocate his business or at least before winter. <br />Shelly Frison, Rose Place resident, agreed. <br />There was no one else present wishing to comment on this matter. <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />RE.SOZ.
