MINUTES <br />CITY COUNCIL <br />MARCH 22, 2000 <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (3) Morelan, Scalze, LaValle. <br />Nays (0). Resolution declared adopted. <br />Morelan and Scalze requested that the City Planner prepare a report <br />outlining the Council's options in this matter. <br />VACATION Scalze opened the public hearing to consider the vacation of certain <br />OF CERTAIN alleyways in the Bemis Heights Addition and Day Avenue. The City <br />ALLEYWAYS Administrator noted that given the hearing was initiated by the City <br />AND DAY Council, it will take four votes of the Council to approve the vacation. <br />AVENUE It was also noted that the Public Works Director has recommended <br /> approval of the vacation. <br />Frank Graczyk, owner of Terrace Heights Mobile Home Park, pointed out <br />that there is a storm sewer in Day Avenue and asked about the retention of <br />easements for that storm sewer. The Public Works Director pointed out <br />that the vacation would deal with the public right-of--way for Day Avenue; <br />however, the City will retain drainage and utility easements. <br />Graczyk stated that he had no problem with the vacation as proposed, his <br />only concern was that the City would retain an easement for the storm <br />sewer. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by LaValle, seconded by Morelan, the public hearing was <br />closed. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOI. UTION NO. 2000-3-70 - TAEL LNG ACTION ON THE <br />VACATION OF CERTAIN ALLEYWAYS AND DAY AVENUE UNTIL <br />THE APRIL. I2, 2000 REGULAR COUNCIL.
