MINUTES <br />CITY COUNCIL <br />AUGUST 9, 2000 <br />TRANSIT HUB The City Administrator submitted for approval a revised copy of the <br />AGREEMENT Agreement with Metro Transit for a transit hub on First Bank Drive <br />& CHANGE adjacent to the Market Place Shopping Center. The Administrator <br />ORDER reported that the City Attorney has reviewed the original agreement and <br />has made some minor modifications. The Administrator noted that the <br />agreement states that Metro Transit will negotiate the change-order with <br />Palda & Sons for completion of the transit hub. Their change-order is <br />conditional upon the fact that it will not delay or negatively impact the <br />City's contract with Palda & Sons for completion of the transit hub. <br />Metro Transit will also be required to reimburse the City for costs incurred <br />with regard to the transit hub. The Administrator noted that the agreement <br />is for a seven year term. <br />Fahey stated that the seven year term seems longer than what was <br />originally proposed. The Administrator thought that Metro Transit had <br />originally indicated four years. He noted that the Agreement gives Metro <br />Transit the right to terminate earlier than seven years and allows them 60 <br />days to restore the site. <br />Morelan asked if the Agreement addressed the potential for redevelopment <br />of the area and relocation of First Bank Drive. The Administrator replied <br />that the Agreement did not provide for potential redevelopment. He <br />pointed out that the long-range plan is for relocation for First Bank Drive, <br />but noted that this will not happen as along as US Bank continues at its <br />present location. <br />The City Attorney reported that the Agreement provides for a mutual <br />agreement to terminate. However, there is no provision for the City to <br />terminate the agreement on its own, <br />Council discussed the matter and it was their consensus that the <br />Agreement should be modified to address the potential of redevelopment <br />in this area. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOI UTION NO. 2000-8-185 -INSTRUCTING THE CITY <br />ADMINISTRATOR TO RENEGOTIATE THE TRANSIT FIUB <br />AGREEMENT WITH METRO TRANSIT PROVH)ING FOR A <br />MINIMUM TERM OF THREE YEARS ANI) GIVING THE CITY <br />THE A7377.ITY TO REQUIRE RELOCATION OF THE TRANSIT <br />HUI3 AFTER THAT TIME AFTER APPROPRIATE NOTICE <br />SHOULD THERE 73E A REDEVELOPMENT PROJECT FOR THE <br />AREA NECESSITATING THE RELOCATION OF STREETS <br />
