MINUTES <br />CITY COUNCIL <br />OCTOBER 11, 2000 <br />Morelan asked what other costs Nelson incurred in connecting to City <br />water. The City Administrator replied that he did not know what the cost <br />was for a contractor to connect to the City water system. It was also noted <br />that it appears that the copper water line was already in place from the <br />street to the house. <br />Morelan suggested that the City offer Nelson the option of disconnecting <br />from the City's water system and a refund of the fees paid to the City for <br />the connection. The Administrator pointed out that she might have had to <br />pay contractor costs that would not be refundable by the City. <br />Morelan suggested that if a mistake was made on the part of the City, the <br />resident should not be hurt by that mistake. However, the resident should <br />not gain from the mistake either. Morelan again suggested that if Nelson <br />would have repaired her well had she known about the $300 water <br />availability charge, the City should offer her the option of disconnecting <br />from City water and a refund of the fees paid to the City. <br />Fahey suggested that the recommendation of the City Administrator that <br />Nelson be allowed to pay the $300 fee over the course of the year be <br />adopted unless there is a compelling reason based on cost data not to <br />impose the fee. Fahey suggested that if Nelson presents this information <br />to the City Administrator, he should bring the matter back to the Council <br />for further review. <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000-10-241-ADOPTING THE <br />RECOMMENDATION OF THE CITY ADMINISTRATOR RELATIVE <br />TO THE WATER AVAILABILITY CHARGE FOR THE NELSON <br />PROPERTY AT 2995 VANDER131E ROAD UNLESS SUSAN NELSON <br />PRESENTS INFORMATION RELATIVE TO COST IMPLICATIONS <br />OF THE WAC CHARGE VERSUS WELL. REPAIR TIIAT SHOULD <br />13E PRESENTED TD TILE COUNCIL. FOR FURTHER <br />CONSIDERATION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Morelan, LaValle, Fahey, Scalze, Pedersen. <br />Nays (0).
