MINUTES <br />CITY COUNCIL <br />OCTOBER 25, 2000 <br />Upon motion by Fahey, seconded by LaValle, the public hearing was <br />closed. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOI. UTION NO. 2000-IO-255 -APPROVING THE AMENDMENT <br />TO CONDITIONAL USE PERMIT ALLOWING COLISEUM <br />I3IL LIARUS TO REMAIN OPEN UNTII.2 A.M. AND APPROVING <br />THE AMENDMENT TO THE MUNICIPAI. CODE EXTENDING <br />THE HOURS OF OPERATION FOR AN AMUSEMENT CENTER <br />CONTINGENT UPONA SIX MONTH REVIEW OF THE COLISEUM <br />137LLARDS OPERATION I3Y CITY STAFF WITH DIRECTION <br />THAT IF THERE ARE ANY PROI3I,EMS IDENTIFIED, THE <br />MATTER WILL COME BACK TO THE CITY COUNCIL FOR <br />REVIEW <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) LaValle, Pedersen, Scalze, Fahey. <br />Nays (0). Resolution declared adopted. <br />CUP - Mayor Fahey opened the public hearing to consider an application for a <br />433 LITTLE Conditional Use Permit allowing a commercial recreation use serving <br />CANADA ROAD - alcoholic beverages at 433 Little Canada Road as requested by K & J <br />K & J CATERING Catering. It was noted that the Planning Commission has recommended <br />approval subject to compliance with conditions. <br />Kurt Adamson, K & J Catering, indicated that he would comply with the <br />conditions recommended by the Planning Commission. <br />Scalze questioned the situation where a business holding an on-sale liquor <br />license can utilize that license to sell liquor in another city. She <br />questioned what enforcement authority Little Canada would leave should <br />their be liquor ordinance violations by K & J Catering when operating <br />their business in Little Canada under a North St. Paul liquor license. <br />Scalze also noted that other liquor businesses in Little Canada must pay <br />the City's on-sale liquor license fee, and she felt it unfair that K & J <br />Catering could use their North St. Paul license and avoid Little Canada's <br />liquor fee. <br />Kurt Adamson reported that K & J Catering has an on-sale liquor license <br />issued by the City of North St. Paul. They also have a caterer's permit <br />issued by the State. Under the caterer's permit State Law allows the sale <br />of intoxicating liquor as an incidental part of food service at a place other <br />than the premises for which the holder's on-sale liquor license is issued. <br />
