MINUTES <br />PLANNING COMMISSION <br />JANUARY 13, 2000 <br />Keis again indicated that the fact is that the trailer sits on the <br />property and is not moved on a regular basis. Therefore, it is <br />considered as a storage unit. <br />Rossow pointed out that the ordinance does not define regular <br />basis. Rossow asked that the ordinance be clarified. Once it is, he <br />would comply with it. <br />Keis indicated that he would not have a problem with the trailer if <br />it were moved once or twice per quarter. However, this trailer has <br />not been moved in a couple of years by Rossow's own admission. <br />Rossow felt that the ordinance needed to be clear so that all the <br />owners in Ryan Industrial Park have the same set of rules to adhere <br />to. <br />The City Planner agreed that the ordinance does not define what is <br />meant by the requirement that a trailer be moved on a "regular <br />basis". However, the ordinance does define what types of uses are <br />allowed on the site, both principle and accessory uses. While <br />storage is allowed as an accessory use, storage of a trailer is not, <br />particu]arly when the storage is not accessory to the principle use. <br />The Planner also pointed out that accessory structures must meet <br />building code requirements, and a trailer would not meet these <br />requirements. The Planner indicated that it is staff's interpretation <br />that the trailer on the Rossow property is not within the realm of <br />allowable uses in this Zoning District. If a use is not specifically <br />allowed, then it is prohibited. <br />Rossow again stated that he felt the ordinance was vague and <br />requested that the issue be more clearly defined. <br />Knudsen pointed out that a construction trailer that does not move <br />is deemed a storage trailer. Knudsen pointed out that storage <br />trailers are prohibited, and pointed out that without this prohibition <br />property owners would used trailers rather than constructing a <br />building of the appropriate size they need. <br />Keis pointed out that to meet the intent of the law, the trailer would <br />have to be moved on a regular basis. <br />Rossow stated that he wanted a more exact definition.
