MINUTES <br />PLANNING COMMISSION <br />JUNE 8, 2000 <br />property should be rezoned to Public given the issues of control that the <br />City has in rezoning a property. <br />Kraemer pointed out that the property would continue to pay property <br />taxes until such time as it is purchased by the school district. The Planner <br />replied that that was correct. However, the same is true if the property <br />remains RB and the City allows public schools as a conditional use in that <br />district. Under either circumstance, if the school district purchases the <br />property for use as a school, the property would come off the tax rolls. <br />Knudsen recommended that the Planning Commission's recommendation <br />in favor of rezoning 433 East Little Canada Road from Residential <br />Business to Public in order to allow the operation of a public charter <br />school from the site remain as previously adopted. <br />Motion seconded by Kraemer. <br />Motion carried 6 - 0. <br />Knudsen recommended denial of the amendment to the Zoning Code <br />allowing public schools as a Conditional Use in the Residential Business <br />(RB) Zoning District as well as denial of the application for Conditional <br />Use Permit allowing the operation of a public charter school as requested <br />by Family Academy for property located at 433 East Little Canada Road <br />given the Commission's position that the City would have more control by <br />limiting the public school use in the Public Zoning District. <br />Motion seconded by Barraclough. <br />Motion carried 6 - 0. <br />CONCEPT Mr. Jeff Bock, Land Holding Company, appeared before the Commission <br />REVIEW - requesting concept review for the development of townhomes on property <br />TOWNHOMES - on Park Street/Rice Street just south of the Goodyear development site. <br />PARK STREET Bock indicated that he is currently having a wetland delineation done of <br />this property. He noted that the concept shows 12 townhomes on the <br />property and indicated that this would be a very low density given the total <br />acreage of the site. The number of units may change given the results of <br />the wetland delineation. <br />Todd Phillips, Park Street resident, reported that he discussed the property <br />with the Division of Waters, and was told that this may be a protected <br />wetland. <br />
