Regular Meeting - June 7, 1955 <br />Mr. Robert Evans, a contractor who is constructing twenty- <br />four homes on Dawson's Suburban Lots in the vicinity of McMenemy <br />Road about a half block North of County Road B, explained his pro- <br />ject and described the lots on which the houses are to be built. <br />The lots are 150 ft. x 230 ft. Mr. Memmer presented a contract which <br />had been executed by Mr. Evans and the Fielding and Shepley Contract- <br />ing Co. together with a surety bond executed by the James Investment <br />Co. to guarantee completion of the road work, which includes con- <br />struction, graveling, surface stabilization with black top, and con- <br />struction of curbs and gutters. <br />Upon motion by Nadeau, seconded by Loeffler, it was resolved: <br />"WHEREAS, the James Investment Co. is developing <br />Lots 29 and 30 of Dawson's Suburban Acres within the <br />Village of Little Canada and has entered into an Under- <br />taking Agreement with the Village and posted a surety <br />bond to guarantee compliance with the Viilaye rules <br />and regulations pertaining to the construction of <br />streets, roads, gutters, and curbs, and <br />"WHI.RF.AS, the Veterans Administration will waive <br />its requirements for escrow deposits to cover the costs <br />of offsite road improvements if it has a resolution <br />from the Village Council unequivocally assuming respon- <br />sibility for the construction of such roads without as- <br />sessment to individual lot purchasers; <br />"NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COllN- <br />CI1_ OF THE VILLAGE OF LITTLE CANADA, That the Village <br />enter into an Undertaking Agreement with James Investment <br />Co. and I~ieiding & Shepley, Inc., whereby the said cor- <br />porations jointly and severally agree to construct, grade <br />and stabilize the roads and curbs and gutters thereof <br />within Blocks 7_9 and 30 of Dawson's Suburban Acres in <br />accordance with all of the specifications, requirements, <br />rules and regulations of the Village pertaining thereto, <br />the said roads and provisions of the contract being as <br />follows: <br />"1. The following streets to be completed on or be- <br />fore July 1, 1956: <br />3rd Avenue between Desoto St. and McMenemy St. <br />Laurie Rd.(2d Ave.) " Desoto St. " McMenemy St. <br />Desoto Street " Laurie Rd. " 3rd Avenue <br />Arkwright Street " Laurie Rd. " 3rd Avenue <br />anti that the Village accept the performanr.e bond of James <br />Investment Co, executed by a corporate surety authorized <br />to do business in the State of Minnesota, said bond to <br />be in the amount of Fourteen Thousand Nine Hundred Seventy- <br />Three and 20100 Dollars (~611~,973.?_0), said bond conditioned <br />upon doing the wort{ and furnishing all of the materials <br />necessary therefor and completing the said streets at the <br />date specified all in strict compliance and conformity with <br />the said Undertaking Agreement and the specifications of the <br />Village c Little Canada. <br />- 2 - <br />
