Regular Meeting - July 8, l59 <br />land owned by Mr. Gordon, it being understood that <br />this area will be used for unloading steel conduit pipes <br />about 40 feet in length and S feet in diameter, weighing <br />approximately 10 tons each, from railroad cars and <br />reloading them onto trucks add also storing pipes on said <br />area." <br />Ayes 5 Nays - 0 <br />The resolution was adopted. <br />Mr, Frank Erling of 2737 Noel Drive asked that a drainage ditch be built <br />on Desoto Street, south of Farm Avenue, because his basement was flooded with raid <br />water that ran off of the ball field west of his lot. Mr. Erling was advised that <br />Desoto Street, from Farm Avenue south had been vacated in 1955. Mr. Nicholson of the <br />School Board, who happened to be present, said he would check into this matter and <br />bring it to the attention of the School Board on the theory that the School District <br />might be willing to construct a ditch along the east side of their property which <br />would lead the water south into Gervais Creek. <br />Mr. Paul Gaul of 380 E. Viking Drive, asked that the Council provide <br />means to drain his yard because the flowers and vegetables he has planted will he <br />destroyed by the water now standing on his garden. There was considerable discussion <br />about the possibility of pumping the water off his property. No final decision was <br />made, because the Village Attorney indicated that he disapproved of eny action by the <br />Council which would imply Billage liability for the water damage complaint of Mr. Gaul, <br />%t had been pointed out during the course of the discussion, that Mr. Gaul's effort to <br />plant a garden last year, met with the same disastrous results, and that he knew, or <br />should have known that he would be faced with the same problem this year. <br />Mr, Dave Frattlaone stated that the Northern States Power Company has <br />been driving heavy equipment down Condit Street, in carrying out its construction <br />program and that as a result, Condit Street has been churned up into an impassable <br />condition. <br />Upon motion by Spooner, seconded by Vitale, it was <br />"RESOLVED, that the Village Attorney be and is hereby <br />instructed to notify the Northern States Power Company that the <br />said company should repair this road without delay." <br />Ayes - 5 Nays - 0 <br />The resol8ltlon was adopted. <br />The nest order of business was further ewisideration of the re-grading <br />and re-surfacing of County Road B-2 from Rice Street westward a distance of 1,200 feet. <br />Mr. Carley, Village Enginoer, again explained the proposed pro,~ect. Mr. Nicholson of <br />the School Board explained that the School would pay for the portion of the street from <br />the driveway to its new school grounds, westward to Rice Street, but did not feel oblig- <br />ated nor authorised to pay any portion of the street construction East of its driveway. <br />The Village Attorney, Mr. Memmer, explained some figures which he presented, pertaining <br />to a possible distribution of costs among the various abutting and benefitted property <br />owners. A11 parties concerned seemed to feel that a solution could be reached on the <br />basis of the Attorney's figures, and the Attorney was Instructed to write a letter on <br />behalf of the Village Council to the School ,Board, outlining the amount to be assessed <br />to the School District, and the reasons therefor. The entire matter was then continued <br />until the next meeting of the Council. <br />- 2 ° <br />
