MINUTES CITY COUNCIL AUGUST 13, 2008 development application fees that would be associated with a CUP for expansion of an existing garage on the property. Keis asked what cooperation in the expansion of utilities meant. The City Administrator reported that it did not mean financial participation, but rather the City's flexibility in how these utilities are planned to make the most economic sense. The Administrator thanked Terrace Heights for their willingness to work with the City on this matter. He felt that the proposed land swap agreement resulted in benefits for both the Park and the City. The agreement makes it easier for the City to accomplish the addition of a second left turn lane on County Road B-2. The Administrator also noted that changes discussed this evening should be subject to the City Attorney's review and approval. Mr. Keis introduced the following resolution and moved its adoption: RESOL UTION NO. 2008-8-190 -APPROVING THE TERRACE HEIGHTS REAL ESTATE SWAP AGREEMENT AS PRESENTED BY THE CITYADMINISTRATORSDBJECT TO THE CITY ATTORNEY'S REVIEWAND APPROVAL, AND AUTHORIZING THE MAYOR AND CITYADMINISTRATOR TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY The foregoing resolution was duly seconded by McGraw. Ayes (4). Nays (0). Resolution declared adopted. NUISANCE The City Administrator reviewed the Code Enforcement Officer's ABATEMENT- report relative to grass nuisance abatement at 990 County Road D East. 990 McGraw expressed concern about security for the pool. He indicated COUNTY he noticed the fence gate open on a couple of occasions. The City ROAD D EAST Administrator indicated that City staff will ensure that the fencing around the pool is appropriately secured.
