MINUTES <br />CITY COUNCIL <br />AUGUST 27, 2008 <br />PROPERTY <br />DIVISION - <br />580 AND 588 <br />EAST <br />COUNTY <br />ROAD B-2 - <br />LaVAQUE <br />request for a Variance. Based on that withdrawal, the City Attorney <br />indicated that no action was necessary on the Variance. <br />The City Administrator recommended that given the adoption of the Text <br />Amendment, the On-Site Air Temp CUP be amended to reflect the <br />amended provisions of the Zoning Code. <br />Mr. Montour inrioduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2008-8-199 -AMENDING THE CONDITIONAL <br />USE PERMIT FOR ON-SITE AIR TEMP, 53 WOODLYNAVENUE, <br />RELATIVE TO OUTDOOR STORAGE CONTAINERS, ALLOWING <br />FOR OUTDOOR STORAGE CONTAINERS CONSISTENT WITH <br />THE NEWLYADOPTED ZONING CODE REGULATIONS <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Blesener opened the continuation of Public Hearing to consider the <br />Property Division of 580 and 588 East County Road B-2 into three single- <br />family lots as requested by Eugene and Theresa LaVaque and Amy <br />Lackner. Blesener noted that action was tabled at the request of the <br />applicant to give them an opportunity to work with Magellan Pipeline <br />to obtain a driveway crossing permit. <br />The City Planner indicated that the Planning Commission has requested <br />approval of the originally-submitted property division. In working with <br />Magellan to obtain a driveway permit, the applicant has amended the site <br />plan widening the proposed new lot from 86 feet to 100 feet. With the <br />additional lot width, the applicant will be able to design a driveway that <br />will meet Magellan's requirements. The Planner noted that the resulting <br />new lot size is now increased to 13,290 square feet, which is in excess of <br />the City's R-1 standards. The Planner noted that all three lots meet zoning <br />standards. <br />Randy Kurth, Kurth Surveying and representing the property owners, <br />reported that they have worked out a driveway agreement with Magellen <br />Pipeline. The additional lot width allows the driveway to be placed in a <br />location that will put over three feet of clearance between the driveway <br />and the pipeline. <br />Blesener asked if retaining walls will be necessary. Kurth reported that <br />with the additional clearance, retaining walls will not be needed. <br />
