MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 11, 2008 <br />EROSION The Commission reviewed the draft of the Erosion Control Ordinance. The <br />CONTROL City Planner reported that there is a lot of cross-over between this ordinance <br />ORDINANCE and the Stormwater Management Ordinance. The Erosion Control <br />Ordinance addresses the on-site details of erosion control relative to <br />development projects, such as silt fencing, street sweeping. This ordinance <br />manages how projects are managed once dirt is disturbed. The Planner <br />indicated that the City already has policies in place for when street <br />sweeping and silt fencing must occur. This ordinance codifies those <br />policies and makes them more explicit. The ordinance also requires that <br />projecting having over 20,000 square feet of disturbed area must obtain an <br />erosion control permit. <br />Mr. Pechmann recommended adoption of the Erosion Control Ordinance as <br />submitted. <br />Motion seconded by Hall. <br />Motion carried 6 - 0. <br />COVERED The City Planner indicated there is a property owner in the City who would <br />PORCH like to add a covered porch to the front of his house. This porch would <br />ADDITIONS encroach into the required front yard, therefore, would require a Variance. <br />The Planner reported that given there is no hardship to warrant the <br />Variance, he has informed the property owner that approval would be <br />unlikely. <br />The Planner reported that the property owner would like to pursue the <br />matter, and he informed him that an option would be to pursue a Text <br />Amendment which would allow the encroachment of covered porches into <br />the front yard setback. The Planner indicated that the Code does allow a <br />maximum 40 square foot vestibule to encroach into the required front yard. <br />The Planner indicated that the porch would have a roof, but there would be <br />no windows, screens, doors, etc. The Planner asked the Commission for <br />their opinion on a Text Amendment of this nature. <br />Knudsen asked the Planner for his opinion. Knudsen also asked about the <br />possibility of a basement under the porch. The City Planner indicated that <br />the porch would be attached and would have footings, therefore, it is <br />possible that there would be a basement under the porch. The City Planner <br />indicated that the reality of these porches is that they would not encroach <br />much more than 6 feet into the front yard. <br />-9- <br />
