<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Bill Dircks, Public Works Director <br /> <br />DATE: December 18, 2019 <br /> <br />RE: Ordinance 840, Amend City Code Chapter 205 – Sanitary Sewer System <br /> <br /> <br />ACTION TO BE CONSIDERED: <br />Adopt Ordinance 840, amending the Subsurface Sewage Treatment Systems portion of City <br />Code Chapter 205, Sanitary Sewer System, and approve publication of a summary ordinance. <br /> <br />BACKGROUND: <br />Staff met with Steven Oscarson of the Minnesota Pollution Control Agency in October to <br />perform an assessment of the City’s Subsurface Sewage Treatment System (SSTS) Program. <br />Part of the assessment was reading through the ordinance and suggesting changes and/or <br />additions to make the ordinance easier to understand and follow. <br /> <br />The SSTS ordinance was revised in 2015 to bring it up to MPCA standards. A model ordinance <br />provided by the MPCA was used at that time to gain compliance. In the years since the latest <br />revision, the MPCA has updated its model ordinance and has more requirements. Those <br />suggested changes and additions have been made to the attached SSTS portion of Section 205 of <br />the City Code. <br /> <br />The major changes include adding more language regarding permit applications, adding an <br />approval process to address requested changes to approved designs, and adopting a construction <br />inspection program for new and replacement SSTS. <br /> <br />Staff very infrequently deals with SSTS in the City. There are only twelve systems left in Little <br />Canada. The last time a system was rebuilt was 2005. For future system permits and inspections <br />staff will contract with a licensed inspector that can review the design and inspect the work. <br /> <br />STAFF RECOMMENDATIONS: <br />Approve the changes to the SSTS portion of Section 205 of the City Code, and approve <br />publication of the attached summary ordinance. Pursuant to Minnesota Statutes Section <br />412.191, in the case of a lengthy ordinance, a summary may be published. <br /> <br /> <br />ATTACHMENTS: <br />Amended portion of Section 205 of the City Code showing changes made, and a summary <br />ordinance. <br />
