MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 2008 <br />Duane Herber reported that he recently purchased a Canabury townhome, <br />and recently learned about the proposed project. Herber indicated that he <br />signed the petition against the HIA and reported that the information that <br />was provided was clear and contained points for why the project may not <br />be appropriate at this time. He felt the information was presented clearly <br />and in an unemotional fashion. Herber reported that he received <br />information on both sides of the argument, but agreed with the petition <br />against the creation of the HIA. <br />The Council discussed the fact that in light of receipt of the petition, it was <br />not necessary to go through the HIA informational presentation. It was <br />noted that the petition against creation of the HIA shows 43% of the <br />ownership against and State Statute requires 35% to veto the HIA. <br />Keis asked about the ability to create an HIA for Canabury Townhouses in <br />the future should the project change and ownership then change their <br />position against. The City Administrator indicated that nothing would <br />preclude Canabury Townhouse ownership from applying for an HIA in the <br />future. He did note that the State Statute allowing creation of HIA's is <br />scheduled to sunset on June 30, 2009, however, the Legislature may act to <br />extend. <br />The Administrator reported that Canabury Square has been established as <br />a Housing Improvement Area and will be moving forward with their <br />project. Fluer Royale may also request creation of an HIA to assist them <br />with some work. The Administrator noted that it was anticipated that <br />should the Canabury Townhouse HIA be created, if the City undertook the <br />road project for the townhouses, it could be combined with other City road <br />work for an economy of scale. The Administrator noted, however, that <br />there is nothing that would require Canabury to have the City design, bid, <br />and build the project. It would be Canabury Townhouses' project. <br />McGraw noted that up to this point, the City has offered to create the HIA <br />if that is what Canabury Townhouses wants. McGraw asked about City <br />staff time and the City Engineer's time in working with the townhouses. <br />The City Adminishator reported that the Canabury Townhouse <br />Association contracted with the City Engineer for his help in initial design <br />work. City staff time was provided to the association. The City <br />Administrator also noted that on October 29`x' he attended an informational <br />meeting at the Canabury Townhouses at which he conducted a <br />presentation of the HIA process. The Administrator indicated that many <br />of those present this evening attended that presentation, while some may <br />not have. The Administrator felt that in light of the 43% opposition, it was <br />doubtful that enough of the ownership would change their position in <br />opposition of the HIA creation. <br />
