MINUTES <br />CITY COUNCIL <br />DECEMBER 22, 2008 <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-12-312 -APPROVING A CONCEPT <br />PLANNED UNIT DEVELOPMENT PERMIT FOR THE COMFORTS <br />OF HOME PROJECT PROPOSED FOR THE COUNTY ROAD B <br />SITE SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CITY PLANNER AS OUTLINED IN <br />HIS DECEMBER 5, 2008 REPORT, THE RECOMMENDATIONS OF <br />THE CITY ENGINEER AS OUTLINED IN HIS DECEMBER 4, 2008 <br />REPORT, AND THE RECOMMENDATIONS OF THE PLANNING <br />COMMISSION <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />REZONING Blesener opened the Public Hearing to consider the Rezoning to Planned <br />AND CONCEPT Unit Development (PUD) and Concept Planned Unit Development Permit <br />PUD allowing the development of an assisted living and memory care <br />PERMIT - community consisting of a total of 52 private apartment units as well as a <br />RICE STREET/ retail building and anoffice/commercial building at the southeast corner of <br />COUNTRY DR. - Rice Street and Country Drive for Comforts of Home. It was noted that <br />COMFORTS OF Planning Commission recommended approval subject to compliance with <br />HOME the recommendations of the City Planner, City Engineer, working with <br /> MN DOT and Ramsey County on access issues, curb cuts, and median <br /> placement, and working on aesthetic and coordination options with the <br /> Taco John's property. <br />The City Planner indicated that the Comp Plan guides this property for <br />mixed land use. Therefore, the Comforts of Home proposal which <br />includes an assisted living and memory care facility as well as a retail <br />building and office/commercial building is consistent with the land use <br />plan. The Planner reported that the applicant has begun to work with the <br />Watershed District regarding site improvements adjacent to the pond. The <br />Planner also noted the Planning Commission's discussion relative to a <br />restaurant use on the site and the resulting parking impacts. The Planner <br />indicated that the parking proposed is less than what the Code requires, <br />however, there could be shared parking between the retail and office <br />buildings. He agreed, however, with the Planning Commission discussion <br />
